Show Free Press - Wednesday, March 3, 1993 - Page 6 PlBLC NOTICES Lehi City Ordinance No. Public Notice Advertising Protects Your Right to Know aft 'totiw., ImmmmwA' t m -- AN ORDINANCE AMENDING THE LEHI CITY MUNICIPAL CODE TO PROVIDE FOR THE ADOPTION AND IMPOSITION OF AN IMPACT FEE FOR CULINARY WATER, SECONDARY WATER (PRESSURIZED IRRIGATION), SEWER, TRANSPORTATION AND ROADS, AND PARKS AND RELATED RECREATION FACILITIES. WHEREAS, Lehi City has adopted an amendment to its General Plan consisting of portions of a land use element, a transportation and circulation element, an environmental element and a public services and facilities element addressing the adequacy and availability of public facilities and services necessary to accommodate anticipated future development; and WHEREAS, the City has adopted an amendment to the Lehi City Municipal Code; and, WHEREAS, the City has adopted an amendment to the Lehi City Development Standards and Public Improvement Specifications; and, WHEREAS, Lehi City has been experiencing rapid growth and a dramatic increase in the number of new applications for building permits and subdivision plat approvals which have put a significant burden on the City's ability to provide adequate public facilities which are available at the time of anticipated growth for essential services such as culinary water, secondary water (pressurized irrigation), sewer, transportation and roads and parks and related recreational facilities; and, WHEREAS, impact fees are a reasonable and legally permissible means of generating the revenue necessary to provide funding to construct adequate public facilities which are necessary to service new development; rirnTii Edmund Adams, LaRae Pectol and, WHEREAS, this impact feeordinance is supported by adequate studies and analysis justifying the need for additional funding in order to assure that Lehi City can provide adequate public facilities, the need for which is created by proposed new development; and, WHEREAS, the amount to be collected in this form of this impact fee is comparable to the amount of funds the City would reasonable expect to expend to mitigate the impact reasonably attributable to new development; and, WHEREAS, the City Council in reviewing this proposed impact fee ordinance has considered a number of factors including but not limited to, the following: 1. The cost of existing capital facilities for water, sewer, transportation and roads, and parks and related recreational facilities; 2. The manner of financing existing capital facilities for those services; 3. The relative extent to which newly developed property and other porpoeties in Lehi City had already contributed to the cost of existing capital facilities; 4. The relative extent to which newly developed properties are entitled to a credit because the City may be requiring owners or developers to provide common facilities that have historically been provided by the City and finance through general taxation or other charges in other parts of the Manti LDS Temple rites to unite LaRae Pectol, Edmund Adams LaRae Pectol of American Fork and Edmund Adams have chosen Tuesday, March 9 to be married in the Manti LDS Temple. The differential inherent in fair comparison of amounts paid at different times; and WHEREAS after consideration of all the factors outlined above, the City Council finds the impact fees imposed pursuant to this ordinance to be reasonable and equitable; and WHEREAS the City Council finds and determines that the impact fees to be imposed by virtue of this ordinance will be expended for capital improvement projects that will have a demonstrable benefit to the newly developed properties against which the fee will be imposed; and WHEREAS it is in the best interests of Lehi City and the health, safety and general welfare of its citizens to adopt this ordinance in order to provide for adequate public facilities necessary to service new development, the need for which is reasonable created by the anticipated new development; NOW, THEREFORE, IT IS ORDAINED BY THE CITY COUNCIL OF LEHI CITY, UTAH, AS FOLLOWS: 1. Any applicant for a building permit under this section may apply to the City Council for a credit against the impact fees paid in the event that the applicant can demonstrate, recognizing the applicant has the burden of proof, that the impact fee required has no reasonable relationship to the needs created or benefits conferred upon the development, does riot demonstrably benefit the new development, is duplicative, or is otherwise unlawful pursuant to the standards of applicable case law or statues then in effect. 2. The City Council specifically finds that it is necessary for the immediate preservation of the health, safety and welfare of the inhabitants of the City that this ordinance take effect immediately and therefore tljis ordinance shall take effect immediately after passage by the City Countil ', and subsequent publication and posting. Lowell has served as Commander of the American Legion and Bobbie as Auxiliary President. They have organized Poppy Drives, helped with Girls and Boys State activities, American Legion baseball, and Gold Star Mothers' luncheons. He has been active in the LDS Church serving as High Priest Group Leader under five bishops. He also has worked with the Little League and Pony League, was president of the Pleasant Grove Senior Citizens, and was instrumental in obtaining the bus which the city and seniors used for several years. Bobbie began her m usical career at the age of three when she was given a little rocking chair and a mouth organ. She knows all the words to every song you'd care to hear her sing. For over 30 years Bobbie has worked as a nurse at the Training School, and Provo and Lehi hospitals and rest homes. She has served in both the stake and ward Relief Society. The couple were also in charge of several senior citizen tours. Their children are Jene, Wes, and Kevin Duvall, all of Pleasant Grove; Jerry Duval, Rosamond, Ca.; PatDeGroer, Sun Valley, Nev.; Tom Duvall, Orem; and Saralyn Freeman, Magna. They have 28 grandchildren and Hospice of IHC sponsors a bereavement group which will meet Wednesdays, 6:30-- p.m. at 1875 So. State, Orem, on the lower level.
