Filed by Jackson Howard, attorney for Allied Plumbing and Heating, the original action sought payment of (566,000 plus interest by the county for satisfaction of the land sales contract for the Devon Industries property. The complaint charged that the county entered into the sales agreement with Allied on Sept. 7, 1976 and paid an initial payment of $100,000, pro mising to pay the remaining $556,000 by March 2, 1977. March 2, 1977. County officials filed an answer and counter-claiasserting that the land sales contract was ultra vires (beyond the legal authority of a corporation) and therefore necessary because Stake Conference will be held the first week-en- d in September, September 3 and 4. A complete schedule of meetings for the conference will be published later. Sevier County Deputy Sheriff Duane Ross said the three men were dead at the scene. The bodies of two were still in the mangled fuselage, the third was lying on the engine. and about 25 members of the Sevier County Sheriff's Jeep Possee were dispatched to the scene. They carried the bodies on stret- chers about 1,000 yards through brush and oak, to four-whedrive vehicles, which transported the bodies to ambulances waiting on the highway. el Investigators said the aircraft was demolished. They were not sure if Mr. Liston was attempting to land on the freeway or struck the ridge trying to miss a nearby power line. Other witnesses said the craft was flying west over the highway. The pilot made a turn and a wing apparently touched the ground. The plane skidded along the ridge for about 50 yards, strewing pieces along the ridge, tearing away one wing and the tail section. Posse members remained at the scene all night. Officials from the Federal Aviation Administration are still investigating the accident. Allied then charged that the three county commissioners were individually responsible, and county officials sought resolution of the conflict through the courts because of collateral agreements in the solid waste plan which had been signed by many of the cities along with the county. The current action therefore involves three combined actions. The first is Allied Plumbing and Heating against Utah County and Commissioners Verl D. Stone, Karl R. Lyman, and Yukus Y. Inouye. Mr. Stone was com missioner at the time the Devon agreement was made. The second action involves Utah County as third party plaintiff, versus the of Alpine, American Fork, Cedar Fort, Genola, Goshen, Lehi, Lindon, Mapleton, Orem, Pleasant Grove, Salem, Spanish Fork, and Springville, the cities which were involved in the Utah County Solid Waste Service District. municipalities v ;, w Hi' , ' The third action involves Allied Plumbing and Heating cities against the above-liste- d as third party defendants. Allied seeks payment against the defendants and third party defendants as follows: (1) For compensatory damages as may be established upon proof; (2) In the alternative, for reasonable rental value of the premises, and (3) For costs of the action. -- Stake will hold Fast Sunday this week, August 28, it was reported by President F.
