Show LEHI FREE PRESS, LEHI, UTAH ORDINANCE building shall have been or is being constructed for residential, commercial or industrial use, any part of which building is within three hundred feet of any street, alley or way in which a public sewer is then in existence and used in the city, to construct or permit to be constructed or to use or permit to be used any privy vault, spetic tank or cesspool connected with such building. Each such owner or other persoi shall within ninety days after having been given notice by the city that an accepted public sewer is ready to receive connections therewith cause such building to be connected with said sewer (except that if such building shall not at the time such notice is given have therein any toilet or toilets, the owner or other person having charge thereof or occupying such building shall have a period of two years in which to connect it with such public sewer) and it shall thereafter be unlawful for such owner or other person to have the plumbing in such building remain unconnected to the public sewer or to maintain or use or cause or permit to exist any privy, vault, septic tank or cesspool to which said building is connected or which is used by the occupant thereof. Whenever an accepted public sewer is available to receive connections therewith the manager of the system shall cause appropriate notice to be served upon the owner, agent or other person having charge of or occupying all property coming within the scope of this paragraph, that said public sewer is ready to receive connections therewith and that all plumbing must be connected with such sewer. Section 11. That the bonds authorized to be issued hereunder and from time to time outstanding shall not be entitled to any priority one over the other in the application of the revenues of the system, regardless of the time or times of their issuance, it being the intention of the City Council that there shall be no priority among the bonds authorized to be issued pursuant to this ordinance regardless of the fact that they may be actually issued and delivered at different times. It is hereby expressly agreed and covenanted that the City of Lehi will not hereafter issue any bonds or obligations payable from the revenues of the system, or any part thereof, until all bonds herein authorized have been paid in full, unless such additional bonds are issued in such manner that they are in all respects subordinate to the bonds herein authorized. The provisions of the foregoing paragraph are subject to the following exceptions: 1. If at any time after the bonds herein authorized, or any part thereof, shall have been issued, the City Council shall find it desirable to refund said bonds, said bonds, or any part thereof, may be refunded (but only with the consent of the holders thereof unless the bonds have matured or are then callable for redemption and have been propertly so called) and the refunding bonds so issued shall enjoy complete equality of hen with the portion of said bonds which is not refunded, if any there be, and the holders of the refunding bonds shall be subrogated to all of the rights and privileges enjoyed by the holders thereby. of the bonds refunded bonds shall be The refunding issued with such details as the City Council may by resolution provide, provided only that if only a part of the outstanding bonds is refunded, the interest rate of the refunded bonds may not be increased, no refunding bond may (Continued from Proceeding Page) all legally available action for the enforcement of all liens securing water and sewer charges which are six months delinquent. The manager shall be required to supply a fidelity bond in the amount of not less than $5,000 to assure the faithful carrying out of his duties and the prompt and diligent enforcement, collection and application of all fees and charges due for he water and service supplied by the system. (j) That the initial schedule of rates for water and services supplied by the system, which schedule shall be subject to such increase and revision from time to time as may be necessary to carry out the provisions of this ordinance, shall be prescribed by resolution to be adopted prior to the issuance of the first of the bonds and shall prescribe rates satisfactory to the purchaser of the bonds. Such rates shall include a minimum charge of Two Dollars Fifty Cents ($2.50) per month for each property connected with the sewer system. (k) That in consideration of the purchase of the bonds herein authorized, the city hereby agrees to abide by the following coven. ants and agreements with the purchaser of such bonds and with each successive holder thereof so long as any of said bonds remains outstanding. As to each property owner 1. who shall within thirty days from the date of the letting of the construction contract for the sewer system to be constructed with the proceeds of the bonds herein authorized, make application to the city for connection with the system, a connection charge of $100 shall be made if the property is improved with a single residence and in consideration of the payment of such fee, the city will have constructed to the property line of such property a service stub. Any owner of unimproved property adjacent to a sewer line to be so constructed may likewise make application and pay a connection charge, in which event, such service stub will be so constructed, but such property owner shall not be subject to the other sewer service charges for which provision is herein made until an improvement shall have been constructed on such property. 2. Owners of properties improved with structures other than single family residences shall pay such increased connection charges as may be hereafter fixed by the City Council pursuant to recommendations made by the consulting engineer. 3. Subsequent to the construction of that portion of the sewer system which is to be initially constructed, the city shall extend such sewer system whenever any such extension can be made in the city in such manner that there will be one additional improved property connected to the extension for every 100 feet of sewer line comprising such extension, including streets and alleys. Property owners served by any such extension shall be subject to the same arrangement as to the payment of connection charges as is hereinabove outlined and shall be entitled to receive the service stubs without additional payment if application therefor is made and the connection charge paid within thirty days from the letting of the new construction contract. 4. In addition to the covenants hereinabove made as to the maintenance of rates and charges the city shall always fix such rates and charges for water and service supplied by the system that the revenues derived from the operation thereof in each fiscal year, after the payment of all expenses of operation and maintenance as above provided, will, in each fiscal year to and including that ending June 30, 1958, be not less than 135 of the amount hereinabove required to be paid into the Sinking Fund in such fiscal year, and as to each fiscal year thereafter, will be not less than 150 of such amount. Section 10. That it is hereby -expressly provided that it shall be unlawful for, the owner or other person having charge of or occupying any property upon which, a times the highest combined interest and principal refor any succeeding quirements twelve months period on all bonds then outstanding and the bonds so proposed to be issued. As used herein, the term "net revenues" shall be deemed to be the revenues of the system as defined in Section 8 hereof after there have been paid therefrom the reasonable and necessary expenses of operating and maintaining said system as provided in Paragraph (a) of said Section 8. (b) The payments required to be made into the City of Lehi Sewer and Water Revenue Bond Sinking Fund must have been made in full. (c) There must be sufficient money in said Sinking Fund, including the reserve, to pay all and interest payable principal therefrom during the eighteen months next succeeding the issuance of the additional bonds. (d) The additional bonds must be payable as to principal on July 1 of each year in which principal falls aae and payable as to interest on January 1 and July 1 of each year. (e) The proceeds of the additional bonds must be used for the making of improvements, extensions, renewals, replacements or repairs to the system. Section 12. That the proceeds of the sale of the bonds herein authorized shall be placed in a fund separate and apart from all other city funds and shall be paid out solely for the purposes for which said bonds are herein authorized. Section 13. That the sale of said bonds to Lauren W. Gibbs of Salt Lake City, Utah, at the price of par and accrued interest to the date of delivery is hereby in all respects ratified and confirmed. If prior to the delivery of such bonds to the purchaser, it shall be ascertained that less than the entire amount of bonds herein authorized is necessary to construct the improvements for which such bonds have been authorized, and such fact shall be certified to the city by the engineers charged with the supervision of the construction of such improvements, the City Council may adopt a resolution so finding and providing that certain designated bonds of the issue herein authorized are not necessary and shall not be delivered, whereupon such smaller amount of bonds shall be delivered to the purchaser and the right to issue the remaining bonds herein authorized shall be considered to one-ha- lf 1900 have been rescinded and the pledge of revenues herein made shall be applicable only to the bonds so delivered in all respects as though such bonds comprised the total issue of bonds herein authorized. So much of the proceeds of sale of such bonds as is hereinabove required to be paid into the Sinking Fund shall be so paid, so much of the remaining proceeds as is needed to pay expenses due and payable at the time of delivery shall be so applied and the remainder of such proceeds shall be placed in escrow in a bank agreed upon by the city and by the purchaser to be held and paid out in such manner and subject to such as shall be embodied in a letter of instructions to be addressed to such bank by the Mayor and Recorder of the City of Lehi and approved by the purchaser of such bonds. Section 14. That the action of the City Council in calling an election for the purpose of submitting to the qualified taxpaying voters of the City of Lehi the question of the issuance of the bonds herein authorized is hereby approved, ratified and confirmed. Section 15. That the provisions of this ordinance shall constitute a contract between the City of Lehi and the holder or holders of the bonds herein authorized to be issued, and that atfer the issuance of any of such bonds no change, variation, or alteration of any kind in the proyisions of this ordinance shall be made in any manner except as herein provided until such time as all of said bonds issued hereunder and interest due thereon have been paid in full. Section 16. That if any section, paragraph, clause or provision of this ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or uneforce-abilit- y of such section, paragraph, clause or provision shall not effect any of the remaining provisions of this ordinance. Section 17. That all ordinances, resolutions and orders, or parts thereof in conflict with the provisions of this ordinance are, to the extent of such conlict, hereby repealed. FRANK E. SHARP, Mayor.
