Show LEHI FREE PRESS, LEHI, UTAH LEGAL NOTICES ELECTION NOTICE TO ALL QUALIFIED ELECTORS OF THE CITY OF LEHI, UTAH: Take notice that on the 20th day of September, 1955, an election will be held in the City of Lehi, Utah, at the places set out in the following Ordinance, and for the purpose of submitting to the qualified voters of said City the questions set out in an Ordinance adopted by the City Council on August 15, 1955, which Ordinance is as follows: ORDINANCE NUMBER 1955 B AN ORDINANCE providing for the holding of a special election in the City of Lehi, Utah, for the purpose of submitting to the qualified electors thereof the question of adopting an initiative ordinance providing for the construction of a sewer system and improvements to the municipally owned water plant and system of said City, and authorizing the issuance of $486,000 Sewer and Water Revenue Bonds for the purpose of defraying part of the cost of such construction and improvements. WHEREAS there has this day been presented to the City Council an initiative petition requesting that the City Council either adopt the ordinance therein set out or submit such ordinance to the vote of qualified electors of the City of Lehi for adoption, said ordinance being entitled: AN ORDINANCE providing for the construction of a sewer system and extensions and improvements to the water plant and system of the City of Lehi the whole to constitute a municipally owned utility to consist of a sewer system and water plant and system; authorizing and providing for the issuance of $486,000 Sewer and Water Revenue Bonds of said city for the purpose of defraying part of the cost of the acquisition of such system, extensions and improvements; prescribing the form and other details of said bonds; confirming the sale thereof, prov iding for the collection and disposition of the revenues of said utility; making other provisions with respect to the op- - . eration of said utility and the issuance of said bonds, and providing for the payment of said bonds, and WHEREAS it has been ascertained by the City Council that at the last preceeding election for governor held in the City of Lehi there were cast for all candidates a total of 1,956 votes, and it has been determined by the City Coun- that the inititative petition for the above entitled ordinance signed by 720 legal voters qualified to sign said petition, and that said petition contains the number of "qualified signers required by Chapter 11 of Title 20 of the Utah Code Annotated, 1953; and WHEREAS said initative petition has been in all other respects cil carefully examined and has been found by the City Council to be full and complete, and to comply in all respects with the requirements of said Chapter 11; and WHEREAS the ordinance set out in said petition has been adopted by the City Council subject to approval of the qualified electors of the City of Lehi, and it is desired to call a special election at which the question of the adoption of said ordinance may be referred to the electors of the City of Lehi qualified to vote thereon; NOW, THEREFORE, Be It and It Is Hereby Ordained by the City Council of the City of Lehi, Utah, as follows: Section 1. That there shall be held in said city on the 20th day of September, 1955, between the hours of seven o'clock AM. and eight o'clock P.M. a special election at which there shall be submitted to the legal voters of said city the question of the approval of the ordinance described in the preamble hereto. Section 2. That all electors of the City of Lehi qualified to vote on said proposition under the provisions of the constitution of Utah and Title 20 of the Utah Code Annotated, 1953, shall be permitted to vote at said election. Section 3. That the polls shall be opened in every regularly established precinct of said city on the day of said election, which precincts, voting places, and the election officials to serve in each precinct, are as follows: Precinct No. I Residence of Mi's. Leslie Larson, Registrar, 241 South 2nd West, Lehi; Ida Gray, Violet Lott, LaRue Prior, Election Officials. Alternates: Charlotte Lewis, Beulah Lewis. Precinct No. 2 Residence of Mrs. Fern Johnson, Registrar; 891 North 2nd West, Lehi; Verda Peterson, Goldie Dickerson, Gwen Dorton, Election Officials; Alternates: Ruby Nielsen, Evelyn Slater. Precinct No. 3 Residence of Mrs. Kate Austin, 189 East 4th North, Lehi; Mrs. Herbert Johnson, Mrs. Sadie L. Russon, Mrs. Wallace Hebertson, Election Officials; Alternates, Mrs. Victor Smith, Mrs. Zella Hansen. Precinct No. 4 Memorial building, 51 North Center Street, Lehi, Mrs. Maude Adams, Registrar; Delia Zimmerman, Leota Peterson, Rula Dorton, Election Officials; Alternates: Alice Broadbent, Alta Webb. Section 4. That the registration agents for the several election districts of said city shall, between the hours of eight o'clock A.M. and nine o'clock P.M. on the first and third Tuesdays immediately preceeding said election, receive and register the names of all persons applying for registration who are legally qualified and entitled to vote at such election or who will legally have acquired a residence (being otherwise qualified), and who will have a right to vote at said election according to the provisions of the law under which said election is to be held, and each registration agent shall give notice of registration required by the general election laws, includof the Utah ing Section Code Annotated, 1953. Section 5. That the registration agent for each election district shall post in at least five (5) conspicuous places within his district at least five (5) days prior to the date fixed for said election the following election notice, which notice shall also be published once a week for not less than four consecutive weeks in Lehi Free Press, a newspaper published and enjoyCiing a general circulation in the I- - . That said election shall be held in all respects, and notice thereof shall be given in all respects, as required by the general laws of Utah pertaining to municipal elections. Section 7. That the proposition to be submitted, and the ballots to be used at said election, shall be in substantially the following form, it being understood that said bal lots shall comply in all respects with the requirements of Chapter 11, and Section 5 of Chapter 7 of Title 20, Utah Code Annotated, 1953: ORDINANCE NO. 1955 A An initiated ordinance adopted on August 8, 1955, subject to approval by the voters, providing for construction of a sewer system and improvements to the water plant and system of the City of Lehi, and authorizing and providing for the sale of $486,000 bonds, payable solely from revenues derived from the operation of said combined water plant and system and sewer system remaining after payment of reasonably necessary operation and maintenance expenses. That the City Recorder is instructed and directed to prepare the publicity pamphlet required by Sections 18 and 23 of Chapter 11, Title 20, Utah Code Annotated, 1953, to incorporate therein the arguments for and against the measure filed with him, in accordance with the provisions of said Section 23, and to distribute said pamphlet to every voter of 'the City of Lehi, either by mailer or carrier, not less than eight (8) days prior to the date herein fixed for the election, at which said proposition is to be voted upon. Section 9. That immediately after its adoption this ordinance shall be signed by the Mayor and City! Each proposal shall be made out on a form obtained at the office of the Architect and shall be accompanied by a Certified or Cashier's check in the amount of for each unit ($20,000.00 for both units) made payable to the order of the Board of Education of Alpine School District, and shall be sealed and filed with the clerk of said Board on or before 8:00 P. M., Monday, September 19, 1955. At this time proposals will be publicly opened and read in the office of said board. The above mentioned check shall be given as a guarantee that the bidder will enter into the Contract if awarded to him and will be declared forfeited if the successful bidder refuses to enter into said Contract after being requested to do so by said Board. The Board reserves the right to accept any or to reject any or $10,-000.- all proposals or waive any infor mality in a Proposal. No bidder may withdraw his proposal for a ieriod of thirty days alter the date set for opening thereof.
