Show FACE SIX. SECTION Zoning Ordinance PROVIDING ORDINANCE OF DISCREATION FOR TIIE REGULATIONS, TRICTS. ZONING COMMISSION. BOARD OF ADJUSTMENT, AND FIXING AND DETERMINING TIIEIR POWER. EE IT ORDAINED BY THE CITY TREMONTON, OF COUNCIL UTAH. AS FOLLOWS: SECTION I. Size of Structures. JRight to Regulate. AN For the purpose of promoting health, safety, morals and the prneral we'fare of the community, the City Council is hereby empowered to regulate and restrict the height, number of stories and size of buildings and other structures, the percentage f lot that may be occupied, the size of yards, courts and other cpen spaces, the density of population and the location and use cf buildings, structures and land for trade, industry, residence and ether purposes. SECTION II. Districts. The City Council is hereby empowered to divide Tremonton City into districts of such number, shape and arrangement as may be deemed best suited to carry out the purposes of this article, and within such districts it may regulate and restrict the erection, construction, reconstruction, alteration, repair or use of buildings or structures, or the use of land. All such regulations shall be uniform for each class or kind of buildings throughout each district, but the regulations in one district may differ from those in other districts. to SECTION III. Regulations Comprehensive Plan. Such regulations shall be made in accordance with a comprehensive plan designed to lessen congestion in the streets, to secure safety from fire, panic and other dangers, to promote health and the general welfare, to pro vide adeduate light and air, to prevent the overcrowding of land, to avoid undue concentration of population, to facili tate adequate provision for tran- water, sewage, sportation, schools, parks and other public Such regulations requirements. shall be made with reasonable among consideration, things, to the character of the district and its peculiar suitability for particular uses, and with a view to conserving the value of buildings and encour aging the most appropriate use of land throughout the city. SECTION IV. Notice. No regulation, restriction or boundary shall become effective until after a public hearing in relation thereto, at which parties in interest and citizens shall have an opportunity to be heard. At least fifteen days notice of the time and place of such hearing shall be published in the official newspaper or a newspaper of general circulation in the city. other OIL SPACE HEATERS ARE AVAILABLE NOW V. and Changes Such regulations, restrictions, and boundaries may from time to time be amended, supplemented, changed, modified or repealed. In case, however, of a protest against such change, signed by the owners of twenty per cent or more either of the area of the lots included in such proposed change, or of those immediately adjacent in the rear thereto extending one hundred feet therefrom, or those directly opposite thereto extending one hundred feet from the street frontage of such opposite lots, such amendment shall not become effective except by the favorable vote of of all the members of the legislative body. The provisions of the next preceding section relative to public hear ing and official notice shall apply to all changes or amend ments. SECTION VI. Zoning Commission. There is hereby created a zoning commission to consist of five members to act in advisory capacity to recommend the boundaries of the various original districts and appropriate regu lations to be enforced therein. Such Commission shall make a preliminary report and hold the public hearings thereon before submitting its final report, and the City Council shall not hold public hearings or take action in regard to zoning until it has re ceived the final report of this commission. SECTION VII. Board of Adjust ment. There is hereby created a Board of Adjustment which shall consist of five members to be ap pointed by the legislative body for a term of three years, removable for cause by the City Council upon written charges and after public hearing. The City Council shall fill all vacancies for the unexpired term of any member whose'term becomes three-fourt- hs vacant. SECTION VIII. SECTION XI. Notice of Hearing Right of Appearance. The board of adjustment shall fix a reasonable time for the hearing of the appeal, give public notice thereof as well as due notice to the parties in interest, and shall decide the same within a reasonable time. (2) To hear and decide special exceptions to the terms of the ordinance upon which such board is required to pass under such ordinance. (3) To authorize upon appeal such variance from the terms cf the ordinance as will not be contrary to the public interest, where owing to special conditions a literal enforcement of the provisions of the ordinance will result, in unnecessary hardship; provided, that the spirit of the ordinance shall be observed and substantial justice done. SECTION XIII. Judgment on Appeal. above-mention- ed powers such board may in conformity with the provisions of this article reverse or affirm, wholly or partly, or may modify the order, requirement, decision the chairman and at such other times as the board may determine. The chairman, or in his absence the acting chairman, may administer oaths and compel the attendance of witnesses. All meetings of the board shall be open to the public. The board shall keep minutes of its proceedings, showing the vote of each member upon each question, or if absent or failing to vote indicating such fact, and shall keep records of its examinations and other official actions; all of which shall immediately be filed in the office of the board and shall be a pub lie record. SECTION IX. Appeals To. Appeals to the board of adjustment may be taken by any person aggrieved, or by any officer, department, board or bureau of the municipality affected by any decision of the ad ministrative officer. Such appeal shall be taken within a reasonable time as provided by the rules of the board by filing with the officer from whom the appeal is taken, and with the board of adjustment, a notice of appeal specifying the grounds thereof. The officer from whom the appeal is taken shall forthwith transmit to the board of adjustment all the papers con stituting the record upon which the action appealed from was aieerw003 C;v SECTION XVII. The city or any person ag grieved by any decision of the board of adjustment of zoning commission may have and maintain a plenary action for relief therefrom in any court of competent jurisdiction. SECTION XVI. City May Enjoin Violation of Ordinance. In any case where any building or structure is erected, constructed, reconstructed, altered, repaired, converted or maintained, or where any building, structure or land is used in violation of this article or of any ordinance or other regulation made under authority conferred hereby, the proper local authorities of the municipality, in addition to other remedies, may institute any appropriate action or proceedings to prevent such unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance or use, to restrain, correct or abate such violation, to prevent the occupancy of such building, structure or land, or to prevent any illegal act, conduct of business or use in or about such premises.
