Cheri Fail, daughter of Mr. and Mrs. Forbes Fail was in the Logan LDS Hospital where she had an emergency operation performed. The operation went well and Cheri is recovering in Logan. Adolph Canto spent a few days in the hospital in Price, but is home again. Lynette Jewkes spent last Wednesday in Spanish Fork with the Carbon High Band. The band took second place in the festival. Mr. and Mrs. Stanley Yokum of Salt Lake are spending the weekend with Margaret's parents, Mr. and Mrs. Wilford Brown. Darlene Lodeserto went to Salt Lake Friday to do some buying for her beauty shop. She spent some time with her family of Salt Lake. Albert Lodeserto hit a deer the other night but nothing was damaged. Lynette Jewkes, Fern Jewkes, Mikel Johnson and Glenda Johnson decorated for the North Carbon Gold and Green Ball on Friday afternoon. The theme of the dance was April Rain. They decorated with an Easter Tree, rainbow, bunnies and nest. A party was given in honor of the first four boys to graduate from primary in six years. The boys were Evan and Kevin Johnson, Jeffrey Stowe and Jamie Blackham. Beryl Woods has been out of town this week, taking care of grandchildren. Judge drops (Continued from page 1) Pappas, the attorney for Malloroy, objected on the grounds the state had not shown sufficient evidence to link the hammer with the victim or the suspect. The Judge supported the objection and would not allow the item to be placed as evidence. The defense then opened its case by calling the defendant, Mr. Malloroy. He said he has lived in Helper about 18 months of the past five years. Joe Myers and Mr. Clark were also called to the stand before the defense rested their case. Mr. Bunnell argued that the evidence was not sufficient for first degree murder but the charge should be dropped to second degree murder. Mr. Pappas requested the involuntary manslaughter charge. In passing on the defense motion, Judge Ruggeri said there was reasonable and probable cause for the defendant to be bound over on involuntary man- slaughter.
