After hanging in the balance for mere than five years, the case of Mrs. Mattie Lowry vs. Carbon county, William Edman, A. E. Gibson, Eugene Santschi, E. C. Lee and John Steele, for damages for the death of Luzon Lowry, was dismissed by Judge Dilworth Woolley of the Seventh judicial district court, Friday. At the early morning session, the plaintiff was net represented by counsel, and Judge Woolley instructed the clerk cf the court to- get in touch with WiUard Hanson, who had been representing the plaintiff in prior trials of the case. The clerK was informed that Mr. Hanson found it inadvisable to attend, and at the 2 o'clock session of the court the case was dismissed for lack of prosecution. The case was the aftermath of an explosion in Helper April 13, 1922, at the time the highway through that city was under construction. An explosion of more than 800 lbs. of TNT was set off, precipitating boulders rjhrough many cf the houses on the streets.
