Thi Beaver election occurs on the instant. Tuk Salt Lake Stake Academy la bow iu good running order. ' Thekk ia a case of scarlet fever at 1044 E. Second South Street. The argument on the motion for new trial in the case of the United States vs. N. V. Jones, charged with bribing a United States officer, occu pied the time in the Third District Court on Saturday until after the News 29th ; went to press. In denying the motion the Court said "As most of the points in the case have been important considered at tbe former trial, I do not Bee the necessity to go over them In detail. I am of the opinion that sufficient reason has not been shown why a new trial should be granted, and the motion is, therefore, overruled." Mr. Varian asked that Judgment be pronounced. Mr. Brown asked that the defendant Jones be admitted to bail pending an Court, appeal to the Supreme of as be was collector Salt as such it Lake County, and he be was necessary that permitted to taxes of work complete the collecting lor the current year, as he was perfor them. sonally responsible Mr. Varian opposed the request, and the Court promptly refused to admit the defendant to ball, remarking that be could appoint a deputy to attend to his business. The defendants were then ordered to stand up. and Judge Zane said Have you anything to say, Mr Jones? Mr. Jones 1 have very little to offer. and what I have will be stated briefly. When I had tbe talk with i ranks, I was not aware that he was an officer of the United States, and I was not conscious of aiding or abetting or In any way at an ouicer oi tne tempting to DriDe government. I had ' Franks' assurance that he was not a deputy, and I was not conscious of any legal wrong doing, at that time, and am not now. Court (to Treseder) Have jou anything to say? Mr. Treseder I would like to say that I have been here six months There has been awaiting trial. great deal oi a row Kicked up about my trying to aeleat the laws of the United States. I never had any ildea of tampering with tbe laws ot the government. Once before I mot Franks, a man came to me and wanted to know it 1 could find out lor him whether there was an indictment I toll' him I would try against him, and to find out. 1 did find out and told him the result ol my investigations. Was there any harm in that? Franks told me distinctly, when I had the talk with him. that he was not a deputy marshal that he was not an officer of the United States. He was very willing to go Into tbe scheme, aud fre quently approached me on the subject witnooi any encouragement irom me first. Then, again, 1 have been charged with conspiracy to murder, aud Court (interrupting) That has noth ing to do who tbe present case. Mr. Treseder I understand that, but it has , prejudiced tbe press and the public agaiust me. 1 have been abused when I did not deserve it. I hope, in passing sentence, you will take L these facts into consideration. Court (to Mr. Jones) If you were not iconscious of wrong doing it is very strange. A man who will attempt to defeat the ends of Justice by bribery is a oaa man and a aangerous man. To attempt to seduce an officer from the path of duty by the offer of money is to commit an aggravated crime, if corrupt men could do this thing with tbe law could not be enimpunity, forced, and the ends of Justice would be defeated. The evidence shows a very aggravated case against both of you. It shows that Treseder and you offered and gave an officer of the government money to disclose that which he nad no rignt to disclose, in order that you might be able to defeat the enforcement of the law. Whether Franks is a bad man or not makes no difference in this case. If he is a bad man be ought to be pnaisbed. He did not take the money with a corrupt motive, but at the instance of tbe United States marshal. I am disposed to make an example in this case. You are an forth roan, and intelligent even ihe poor excuse caaaotput of Ignorance. You will be confined in the penitentiary for three years. Mr. Jones said nothing, and the Opart asked Treseder whether he had been convicted of any crime before. He replied that he had, twice. After remarking that his former experience had not done much toward reforming, of him, the court imposed a the penithree years' Imprisonment inpenalty tentiary. Mr. J ones was then taken from the where, evidently with the intention of humiliating him to as great an extent as possible, he was handcuffed to Treseder, and afterward removed to the penitentiary. Q. was being constructed through Castle Valley, a quantity of giant powder was buried near the depot at Price, on land that belongs to Mrs. Joseph Birch. A num- -' ber of buildings have since been erected on this land, one of them being an outhouse over the spot where the powder was curled. These buildings have been leased to Mr. 8. S. Jones, of Provo, who occupies one of them as a store. His business la in charge of aoung man named Taylor, who, on Saturday last, employed a man named C. C. Anderson to remove the outhouse: While thus engaged Anderson drove a pick into a can of the giant powder, about which neither be nor Mr. Taylor knew anything, and which seems to hare been entirely forI gotten.
