Show Twenty-Sscon- d Ruls How Shall tlie Votes be Counted IText ) ': i . February. ' ; I Tiie twenty-secon- d joii.t liiinof Cougress, which haa been of late the subject of so much discussion, was adopted. February 6, 1865. It piovideu that the.tlwo Houses of Congress should meet in the Hou.-;of Representatives, the President of tho Senate presiding, on the second Wednesday of February succeeding the meeting of presidential to count the vote by tellers, electors, one for the Senate and two for the House. If on reading any of the certificates a queatiou as to counting the votes it certified arose, the same having been stated, the Senate should withdraw and each House of Congress decide upon it. Ko vote objected to should Jbe counted unless by the concurrent vote of both houses.. In other words, either House could throw out the vote of any or every State in the Union. This rule obtained at the counting of the presidential voteoflS'33, ISO'.) aud 1S7.", and popular attention was nrst called to it a few weeks since by Mr. John W. Forney, who in a violent speech expressed his feaf lost the democratic Houee next February; should reject the vote of sucn wtates as eouta Carolina, and so count Mr. Tilden in. Mr. Forney being a republican and having served as clerk of the House of Representatives under Loth democratic and republican speakers, and also as Secretary of the Senate from 1S31 to lbbb, his assertion carried con siderable weight with it, and the subject was at once taken up. Al most at once tne republican press took up ft new position, and in stead of inaceriTing danger in the existence of the rule claimed that it was no longer in existence. Up on this point there has been more argument made and opinion ex prewea than lact adduced; hence the World deems it of interest to give both sides of the case, leaving it to its readers to frame their own opinion. BRC, (Successors to J. II. UAQUE,) JAKE Slain Ntreet, Flrnt Door North of tli Kleplinut More, Halt lake tHy, Senate, adds t;Upou the main question whether either house can recede from a joint rule adopted by a previous Congress, 1 have no doubt. Each house has tho power to adopt its own rule of' precedure. No authority can limit this power, except by a change in the Constitution. Tho rules of one house do not bind its successor, unless acquiesced in or adopted by it. An act of Congie.-- s approved by the President caunot bind a subsequent house as to rules and order of business Joint rules are but the concurring opinions or rules of two independent bodies, and cannot bind their successors tr prevent either house from receding from them. They are matters of mutual amity and convenience, tc continue while both parties agree to them, and to be revoked at the pleasure of either. Any other principle would destroy the independence of the respective housva. While, therefore, I am clear that the Senate had the power to jBUd did recede from the twenty-secon- d joint-rulyet it U a matter of grave regret and solicitude that somonvode of, .settling, a disputed vote in the tVtoiai. college has not been provide! for, for it is easy to conceive such a contingency when sucli a dispute would involve us in civil war. We can enly hopo that the good fortune that has attended us so far will toutiuue; that the very gravity of the danger will compelCo" ail parties fairly and hou-est- iy submit to the. wish of the majority, expressed In constitutional forms, and that the counting of the vote by the Vice President in the presence of both houses will be so impartially done as to command respect aud acquiescence. It is a danger that should be guarded against by a constitutional amend-men- t. Perhaps for the count the two housesapproaching can agree upon a joint rule, free from the conceded defects and dangers of the former twenty-secon- d joint rule, though I hope that the popular choice will be so strong in lavor of Governor Hayes that there will be ne manner of doubt a3 to theie-sult.- ". .
