Lena Butcane, who had previously pleaded guilty, withdrew the plea and pleaded not guilty. In the case of John S. Latham ra. Win. J. Bvbee, John Bradley, Thomas Frazier, Willis Booth, Jr., Fred Maasa, Mark Fletcher, George Kteteon, B. C. Walton, Andrew Koee and Herbert Orme. The prosecution called the following witnesses: Will R. Burt, Josephine Thompson, Win. Brown, J. W. Metcalf and Thomas Burl. The witnesses for the defendant were: John Brown, E. Mad-en- , Charles L. Lippincott, O. B. Clausa-musseJ. II. Knause, Charles Turner and George Like. Chas. Turner will bo remembered as the colored porter in Maden's saloon, wha was charged with shooting several times at James Griflln on the night of the murder of John Hairier, and who wan supposed to have fired the shots which wounded Griflin. It is understood that this charge of shooting was ignored by the grand jury, for what reason has not been made public. He was arrested, according to the testimony of the witnoss for the prosecution, on the 2d of December, and a lot of stolen goods were found in his room and the possession of a lady friend, Miss Thompson, amounting in Josephine value to about $300, and connected him with tho burglary of Burt Bros.' store on the night previous. By one witness Turner was said to have confided his crime to the officers and to have related the story of the entrance to the store by But later he way of an elevator. changed his tactics and denied every o, irt thing-Mr. Broom, El wood Maden. and other witnesses testified to the good behavior and faithfulness of the defendant while in their employ, and all that could bo dug up as to his past career, which was at all unsavory, was that he had once been in the Cincinnati jail for some petty offense. Turner, on the stand, spun a very plausible yarn of his enforced connection with the robbery. He had gone to his room on the night of the robbery, after having had a hard night's work at the saloon. He found the stolen goods lying on a sofa, together with a note which read: "Will see you later." He had no idea where these goods came from and made no effort to find out Miss Thompson, a colored lady friend, called a little late and finding these silks, etc., coveted the same, and Turner "took tho liberty" of presenting her with what she could carry. She police saw her carry them away and were thus able to trace tho remainder.
