A letter from the Bureau of Land Management regarding a trespass of county owned equipment was discussed. Comm. Marshall had instructed the Milford Road Crew to construct or change a road alignment south of Miners ville. The road In question is in Iron County and the changed alignment was on property owned and administered by the BLM. Comm. Marshall had not obtained a the work from the right-of-w- permit for ay and the work was done without the knowledge or consent of the other members of the Board of Commissioners. The letter stated the BLM would be willing to settle the matter if the following conditions were met: 1. The Board sign the "Unauthorized development Settlement Agreement"; 2. Pay $348 for administrative expenses; 3. Put the disturbed ground back into its original condition; 4. Re -- seed the disturbed ground with crested wheat grass at a rate of not less than 8 pounds per acre in Sept. or Oct. 1989. The administrative fee cannot be paid out of Class "B" Road funds. All work previously charged to the road fund must be adjusted out to avoid problems with the 1989 Annual Audit. These include salary of men and use of equipment. Upon being asked, Comm. Marshall stated he was taking full responsibility for all actions taken reBLM garding the trespass. Members of the Board discussed condition 2 of the BLM agreement. Comm . Sherwood stated that in his opinion, Comm. Marshall should personally pay the bill.Comm. Marshall objected to this statement and considerable discussion was had on the subject. Comm Marshall moved that the County pay the $348 administrative expense out of the general fund. The motion died for lack of a second. The Board expressed appreciation for the BLM's willingness to settle the matter. The BLM was also notified that the Board could not come to an agreement on condition "2 on payment of the administrative fee . No motion was passed. The BLM recommended paying the administrative fee by waiving part of the fee for installation of a cattle guard. It was moved by Comm. Marshall, seconded by Comm. Sherwood and unanimously passed to waive part of the next installation fee. The Clerk will notify the BLM when the Installation has been done. Comm. Johnson stated that the matter was not resolved regarding the inappropriate use of Class "B" Road funds. The matters was continued to the June meeting for further discussion and action. In other business, ConnieC. Marshall met with '.ae Board to discuss the activities of the 1989 County Fair. Commissioners approved to appoint Mrs. Marshall as chairman of the Fair Board, and to offer someone $30 per month for Maintenance of the grounds. Mrs. Marshall informed the Board of the activities planned for the Fair and requested funding to make some ropalrs to the fair building and grounds. The Commission approved $730 for the following: A new stove element; cleaning of the ceiling panels damaged by a leak in the roof previously repaired; new flower shelves; 2 umbrellas for the patio; 4 gallons of paint; and new panels for the rodeo grounds. A letter from Jones & DeMllle Engineering regarding proposed changes to the North Creek Road Project was read and discussed. The letter was referring to proposed changes in fgnclng materials for the roadway. The change will result In an Increase cost to the of $20. It was moved by Comm. Marshall, seconded by Sher County unanimously passed to approve the proposed change. Also discussed was a transmittal for approval of engineering fees for the project. It was moved by,Comm. Sherwood, seconded byMarshalland unanimously approved to sign the wood and transmittal. Notice regarding new underground storage tank regulations was read and discussed. The matter was referred to Comm . Sherwood. The trict AGRICULTURE 2) NO. 19 The Board of County Commissioners met on May 1, 1989 at 10:00 NEWS 1989-9- 0 contract for the Dis- and Circuit Courts was re- viewed. The Clerk recommended some changes to the proposal prepared by the State. It was moved by Sherwood, seconded by Marshall and unanimously approved to propose a contract to the State for and $37,765 for the year 1989-9- 0 $35,210 for the year 1990-9- 1. Norm Thompson andMichaelShaw met with the Board to discuss the settlement of the Western Area Power Administration litigation discussed in the April 3, 1989 meeting. After some discussion, it was moved by Sherwood, seconded by Marshall and unanimously approved to sign Resolution $89-0- 2 authorizing the settlement proceedings. After a public hearing, the Commission approved the following re -zonement petitions: Danny Ytrdley; Harry Wagner and David Marshall: ' ler. The Commission tabled the Paul Anderson, and Jeffrey D. of Frank Harris to further review new regulations. Harry Wagner, David Marshall and Bryce Gale met with the Board to request financial help in purchasing a new harrow for the Beaver County Thoroughbred Association for use at the race tracks in the county. It was approved to pay $3,000 towards the purchase of the harrow. Harry Wagner met with the Board to request help from the County In sponsoring American Legion Boys State. The Board asked Mr. Wagner to submit a proposal next fall for consideration in the 1990 budget. Requests for and U -- 8 --6881 were reviewed. The Commission unanimously approved to grand the requests. It was moved by Comm. Sherwood seconded by Marshall and unanimously approved to sign the lease with Milford City on the Milford J.P. Office In the amount of $1200 per year. The Board had previously advertised for bids to purchase a new pickup for the road department. No bids were submitted. Comm. Sherwood had received 2 proposals from personal contacts; from Bradshaw Chevrolet for $16,042 with a gas engine and Ron's Chevrolet for $16,751 with a dlesel engine. Because of the differences in the two trucks, the matter was referred to Comm. Sherwood for examination of the different options available on each truck in order to make a fair decision. David Penney met with the Board to submit a proposal to buy two parcels of land owned by the County. The serial numters are Kes-petltl- on 85 941-A-- and 941 30 32. It was moved by Marshall, seconded by Sherwood and unanimously approved to offer both parcels to Mr. Penney for $542. Craig Davis met with the Board to discuss his employment status continued from the April meeting. Mr. Davis stated that he would accept the full time position offered to him by the Board at the rate of $18,000 per year. Mr. Davis stated that he was still negotiating to resolve other business dealings, but they would not interfere with his County work. Parcels for the May Final Tax Sale were examined. It was moved by Sherwood, seconded by Marshall and unanimously approved to sell all parcels for taxes, penalties, interest and costs except for the mining claims, which will be sold at the rate of $10 per acre. Please take donations to Gloria McDermott Minersville Town Council Meeting regular meeting of the Minersville Town Council was held on Monday, May 1, 1989 at 8:00 p.m. in the Minersville Town Hall. Prayer: Todd McMullln; Minutes, approved as read. Those present: Phyllis M. Truman; Todd McMullln, and Imelda Banks. Visitors: Kevin Carter; Tammy Noble; Debbie Parson, Payne and Connie Marshall. An adjustment was made on 3 water bills that were extraordinarily high becuase of water leaks during the winter months. Connie Marshall andTamara Payne met with the council to discuss plans for the Beaver County Fair. The fair will be held August 1989. A request for a donation of a planter full of flowers was approved. Also a request to donate money to sponsor the Beaver County Fair Queen in her competition at the Miss Utah pageant was approved. Todd McMullln made a motion to donate $20 to the Beaver County Fair Queen to help sponsor her in the Miss Utah Pageant. Also to donate one barrell full of planted flowers to the Beaver County Fair Grounds. Imelda Banks seconded the motion. The motion passed.The Council was asked to appoint someone to prepare a photographic history of Minersville Town for competition at the Fair. Also the Council was asked to support all fair activities. Town Marshall Kevin Carter reported that his police truck needed some maintenance work and also some new tires, He was told to get some cost estimates of the work that is needed and to report back. Mayor Truman reported that she contacted CahleView Incorporated and that they are making preparations to bring cable TV to Minersville in the near future. Town Clerk Sue Carter reported on a meeting she attended at Job Service concerning the Summer Youth Work Program. The Town will benefit by participating In this program . Because of some reported water pressure problems, the watering at the park will have to be done early In the morning or at night. Upgrading of the water system will continue through the summer. Mary Pat from the State Dept. of Health met with Mayor Truman on April 12, 1989, to inspect the waste disposal site. The purpose was to determine If the site is suitable for the purpose of waste disposal. The Town has not yet received her report. The approval of the site is necessary before the land can be purchased from the BLM. New signs are being prepared for placement at the disposal site to help direct the dumping. Other discussion included preparation for Memorial Day at the cemetery. The role of Justice of the Peace for Minersville Town; Delinquent water and sewer bills; Delinquent Dog taxes; The roads will require very minor maintenance this year. Imelda Banks made a motion to pay all bills presented .Todd McMullln seconded the motion. The Motion passed. Meeting adjourned. Milford City reported vandalism at the swimming pool. Investigation showed eight sprinkler heads either broken off of missing from the sprinkling system. A report of theft from a vehicle at Dog Valley Rest Area was taken. The driver reported items of clothing, camera lens, and other articles valued at over $2000 were missing when he returned to his vehicle from visiting the restroom . The report was sent to Millard County for investigation. An incidentof illegal entry into a home in Beaver is being investigated. The owner reported nothing missing. A Wallsburg, Utah man was arrested by Utah Highway Patrol for Driving Under the Influence of Alcohol. He was booked into Beaver Jail. County Two men were removed from the bus and charged with Intlxlcatlon. Beaver County Sheriff's Department responded to 16 requests by citizens for assistance and investigated two property -- dam age traffic accidents.
