Forrest, Dr. J. A. Booth, and Pay, went to Salt Lake Wed- "bday whre they met with the Stato Road Commission for the purpose of securing the city's share of the county appropriation for two blocks of Main Street Paving. Juab County appropriated om $40,000.00 for the county's share of the paving project through Nephi City, with the provisions that a pro rata share be given the city for the two blocks In the business section which is paved from curb to curb. This money was turned over to the State Road Commission n the regular transaction of such business with that body. The city now needs this money hence the trip to Salt Lake City. The amount is said to be between three and four thousand ' dollars which the city claims should rightfully come to them. '.:k''.! 1 - J 1 James Carter, resident of this city for over half a century and a highly respected citizen of this community passed away at his home here Sun day evening from the infirmities of old age, the deceased being past 82 years of age at the time of his death. Born In Cold Ash, Berkshire, Eng land, In the year 1842, he emigrated with his parents to the United States In 1854, at the age of 12 years. The for family resided in Alton, Illinois, Ne, two years, and t Fort Kearney. braska, for six years.' On Good 'Fri day.' 1862. the family started for Utah crossing the plains in ox teams, arriving in Salt Lake.. City on Sept 29 th of the sanj year. The family then moved to Wanship, Summit County, where Mr. Carter resided for several years coming to Nephi in 1874. Mr. Carter was Joined in marriage to his wife who still survives him, in the Old Endowment House, Salt Lake City on. Monday, March 16th, 1874 To this union six children were born. five of whom survive him. These are: J. H. Carter, Mrs. S. D. Broadhead Mrs. Barton Brough. John W. Carter, and Mrs. E. L. Guyld, all residing In Nephi. Powers, 7, - .Monday and Tuesday of this week an' Interesting case involving the domestic troubles of Mr. and Mrs Fred Lamb of Eureka, and the high handed methods of Eric A. Bylund, Chief- Probation Officer of this district was heard before Judge Burton. The first part of this domestic trouble was heard by the court when Fred Lamb charged his wife with being insane. She was examined by Dr. Beckstead and Allred who reported that she was sane. Enter now Eric Bylund, Chief Probation officer who about July 1st, enters the home of Mr. Fred Lamb, who already had possession of their old baby and informs Mr. Juamb that he had authority to take the baby, which he did, and placed H with a third party at Payson, Utah. , July 5th, Mr. Lamb was ordered by Judge Willis, Judge of the Juvenile Court of this district to appear in Provo. No papers were filed on Mr. Lamb, and no charges made. Mr. Lamb appeared as requested and was ordered to pay $40 per month for the support of the child. Mr. Lamb now thought it was time to lake some action so through his Attorney, J. H. McKnight, enters a writ of prohibition in the District Court citing Judge Willis and Bylund to appear in court here Monday of this week and show cause why they should not be enjoined from further; interference in. the do mestic affairs of the Lambs. A collision now occurred between the authority of the District Court' and that of the Juvenile Court, when udge Willis filed, a motion to dis miss the writ of prohibition on the grounds that the District Court ' had j uria4 lclioiav- After ieariog th arguments Judge Burton decided that the Juvenile Court was tn ferior to the District Court, and that the latter had Jurisdiction to issue the writ of prohibition. Counsel for Mr. Lamb then submitted testimony at the conclusion of which. Judge Burton found that the Juvenile officers and acted without any authority in taking the child and severely reprimanded Officer Bylund for his conduct; and unwarranted Interference in the domestic relations of Mr. and Mrs. Lamb, and that all acts of the Juvenile Court in the matter were null and void.
