And now what is the Board's position? Bids were advertised for according to law. They were publicly opened in a regular meeting called for the purpose. Every bidder knew what kind of heating system he was bidding on and what the price would be. The Midgley Heating system was specified in the plans for the simple reason that this system had proven itself the h.est by test, and was being used by the State itself. These plans and specifications had been submitted to the only known authority that the law recognizes, namely. Dr. Jensen, State Supt of Public Instruction, and the State Architect Jos. Konson, both of whom approved the plans and specifications and signed them. On this approval the Board let the contract for heating to the lowest bidder. Along about this time the Board received a letter from Mr. Burton, as County Attorney, drawing the attention of the Board to an opinion of the Attorney General In which it was claimed that competition was shut out where a particular system had been specified. The Board made investiand gations concerning the same, uere legally advised that they had followed the law and were also the sole Judges of what kind of a system should be installed In the building. Furthermore, the contract had been let and the work proceeding. Claiming, that he was being urged to action by the Attorney General and Governor Mabey, Mr. Burton sought a restraining order from the court as a private citizen which was granted by Judge Knox, and the date set for hearing same was set for Sept 18th, with the result as given at the commencement of this article. The peculiarpart about the whole proceedings, is the fact that Attorney General Cluff, has written and talked to a number of people on the matter, but yet has never sent a single letter to the Board of Education here who were most vitally concerned.
