Show Utah State Bar Supports Malpractice Group Report The Utah State Bar supports the report of the Governor's Malpractice Insurance Evaluation Evalua-tion Committee (The Rosenblatt Rosenb-latt Committee) issued on Friday. November 28, 1975. The measured and responsible responsi-ble recommendations of the Rosenblatt Committee certainly certain-ly deserve the careful consideration consider-ation of the Legislature. The recommendations include several immediate legislative changes which will be helpful in resolving the malpractice insurance in-surance problem without, on a panic basis, uprooting long standing procedures and traditions. tradi-tions. The Bar endorses the proposal propo-sal to shorten the applicable statutes of limitations. It is believed that shortening of the statute, particularly as to minors, min-ors, will reduce the need for insurance companies to maintain main-tain reserves for unreasonably long periods. The Bar also supports the specific recommendations for the elimination of the ad dam num clause, required notice prior to filling a medical malpractice mal-practice suit, strengthened peer review for doctors and other health care providers and the credtion of an in depth study commission. The Governor's Committee perceives a vital difference between the situation in Utah and that in some other states. The report recognizes that the insurance problem in Utah has not reached the crisis proportions propor-tions of states such as California. Califor-nia. In Utah, unlike some of the larger states, we still have time to undertake an in depth study and arrive at reasoned and carefully thought out solutions while, in the interim, doing what can be done to make the climate more hospitable for the insurance industry. The Bar agrees with the committee that to adopt panic legislation which might well contain ill advised or unconstitutional provisions is no solution at ail but merely an aggravation of the existing problem. The Bar noted with approval that the Rosenblatt Committee did not recommend a limitation on damage awards in malpractice malprac-tice cases. Such a limitation has already been found unconstitutional uncon-stitutional in our sister state of Idaho but even if valid flies in the face of the principal that there should be fair compensation compensa-tion for the injur' sustained if caused by the neglet of another. an-other. In our Bar studies of the problem, we have found that excessive verdicts are not a real problem in the State of Utah. Unlike California, which now averages a million dollar verdict almost weekly, there has never been a malpractice verdict in Utah which exceeded $350,000. We attribute this to the reasonableness and traditional tradi-tional conservatism of Utah juries. Under the conditions in Utah, the imposition of a limitation limi-tation on awards would not appreciably alleviate the malpractice mal-practice insurance problem but would seriously limit the rights of injured persons. Some people are quick to con-dem con-dem cliches, but what is a cliche? It is a truth that has retained its validity through time. Mankind would lose half its hard earned wisdom, built up patiently over the ages, if it ever lost its cliches. When we are young we try to hide our poverty. When we grow older we brag about it.
