An Ordinance AN ORDINANCE LEVYING A SPECIAL TAX COVERINQ SPECIAL IMPROVEMENT DISTRICT DIS-TRICT NO. 8 AND PROVIDING FOR THE ASSESSMENT OF PROPERTY IN SAID DISTRICT. DIST-RICT. BE IT ORDAINED BY THE CITY COUNCIL OF AMERICAN FORK CITY, UTAH: SECTION I. That the City of American Fork, a municipal corporation, does hereby levy a special tax pursuant to the provisions pro-visions of Section 516, Chapter 28, of the Revised Ordinances bf American Fork City and 10-7-45 Utah Code Annotated, 1953. That such levy and tax is to attach at-tach pursuant to the provisions of Chapter 28, Revised Ordinances Ordi-nances of American Fork, 1950, to that property contained in what is referred to as Special Improvement District No. 8, and more particularly described hereafter. It Is the purpose of this assessment to raise revenue to pay the costs and expenses of improvements in Special Improvement Im-provement District No. 8. SECTION II. This special tax is levied upon all real .property bounding and abutting on each side of the improvements which have been made, and which are hereinafter described which property is to be especially effected ef-fected and benefited by said improvements, im-provements, and it is hereby adjudged ad-judged and determined that all such property has been benefited by said improvement to the full amount of the taxes hereby levied, lev-ied, and said lots and tracts of land are hereby assessed in accordance ac-cordance with the linear foot frontage abutting on each side of said streets to the full depth of said lots and tracts of land. SECTION III. Provided that one or more installments or the entire amount of said assessment may be paid within 15 days from the date of said levy. One or more installments in the order in which they are payable, or the whole special tax may be paid after said 15 days and be fore the first installment becomes be-comes due, by paying the same with interest from the date of levy to the date such first in stallment Is due. Betty Wight City Treasurer and Collector of Special Taxes SPECIAL ORDINANCE AN ORDINANCE IMPOSING A CITY SALES AND USE TAX, PROVIDING FOR THE PERFORMANCE PER-FORMANCE BY THE STATE TAX ' COMMISSION OF ALL FUNCTIONS INCIDENT TO THE ADMINISTRATION, OPERATION, OP-ERATION, AND COLLECTION OF A SALES AND USE TAX HEREBY IMPOSED, AND PROVIDING PRO-VIDING PENALTIES FOR VIOLATION VIO-LATION THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF AMERICAN FORK CITY, UTAH: Section 1. Title. This ordinance ordi-nance shall be known as "The Uniform Local Sales and Use Tax Ordinance of the City of American Fork." Section 2. Purpose. The City Council hereby declares that this ordinance is adopted to achieve the following, among other purposes, and directs that the provisions - hereof be interpreted inter-preted in order to accomplish these purposes: (a) To adopt a sales and use tax ordinance which complies with the requirements and limitations limi-tations contained in the Uniform Local Sales and Use Tax Law of Utah, Chapter 9 of Title 11, Utah Code Annotated 1953, as amended. (b) To adopt a sales and use tax ordinance. . which incorporates incorpor-ates provisions indentlcal to those of Chapters 15 and 16 of Title 59, Utah Code Annotated 1953, as amended, to wit: The Emergency Revenue Act of 1933, and the Use Tax Act of 1937, respectively, insofar as those provisions are not inconsistent with the requirements and limitations limi-tations contained in said Uniform Uni-form Local Sales and Use Tax Law of Utah (c) To adopt a sales and use tax ordinance which imposes a one half of one per cent (Vi) tax and provide a measure therefor there-for that can be administered and collected by the State Tax Commission in a manner that adapts itself as fully as practical to the existing statutory and administrative procedures followed fol-lowed by the State Tax Comimis-sion Comimis-sion in administering and collecting col-lecting the sales and use taxes of the State of Utah. (d) To adopt a sales and use tax ordinance which can be administered ad-ministered in a manner that will exclude the receipts of particular particu-lar sales from the measure of the sales tax imposed by this city which have been included in the measure of the sales tax imposed by any other municipality munici-pality and county of the State of Utah, other than the county in which this city is located, and avoid imposing a use tax on the storage, use or other consumption consump-tion of tangible personal property proper-ty in this city when the gross receipts from the sale of or the use of that property have been subject to a sales or use tax by any other municipality or county coun-ty of the State of Utah, other than the county in which this city is located, pursuant to a sales and use tax ordinance enacted en-acted under the provisions of said Uniform Sales and Use Tax Law of Utah. Section 3. Operative Date of Contract with the State. This ordinance shall become operative opera-tive on July 1, 1961, and prior thereto, this city shall contract with the State Tax Commission to perform all functions Incident Inci-dent to the administration and operation of this sales and use tax ordinance, and provided further, that this ordinance shall not become operative prior to the operative date of the Uniform Local Sales and Use Tax Ordinance of the County of Utah. Section 4. Sales , Tax. (a) (1) From and after the operative opera-tive date of this ordinance, there is levied and there shall be collected col-lected and paid a tax upon every retail sale of tangible personal property, services, and meals made within the city at the rate of one half of one per cent (y2). (2) For the purposes of this ordinance all retail sales shall be presumed to have been consummated con-summated at the place of business busi-ness of the retailer unless the tangible personal property' sold Is delivered by the retailer or his agent to an out ofrstate destination desti-nation or to a common carrier for delivery to an out-of-state destination. In the event a retailer re-tailer has no permanent, place of business In the state, or has more than one place of business, the place or places at which the retail : sales are consummated shall be as determined under the rules and regulations prescribed and adopted by the State, Tax Commission. Public utilities as defined by Title 54, Utah Code Annotated 1953, shall not be obligated ob-ligated to determine the place or places within any county or municipality where public utilities utili-ties services are rendered, but the place of sale or the sales tax revenues arising from such service allocable to the city shall be as determined by the State Tax Commission pursuant to an appropriate formula and other rules and regulations to be pre scribed and adopted by it. (b) (1) Except as herein after provided, and except inso far as they are inconsistent with the provisions of the Uniform Local Sales and Use Tax Law of Utah, all of the provisions of Chapter 15, Title 59, Utah Code Annotated 1953, as amended and in force and effect on July 1 1959, insofar as they relate to sales taxes, excepting Sections 59-15-1 and 59-1S-21 thereof, and excepting for the amount of the tax levied therein, are here by adopted and made a part of this ordinance as though fully set forth herein. (2) Wherever, and to the extent ex-tent that in Chapter 15 of Title 59, Utah Code Annotated 1953, the State of Utah is named or referred to as the taxing agency, the name of this city shall be substituted therefor. Nothing in this, subdivision shall be deemed to require substitution of the name of the city for the word "State" when that word is used as part of the title the State Tax Commission, or of the Constitution Constitu-tion of the State of Utah, nor shall the name of the city be substituted for that of the State in any section when the result of that substitution would require re-quire action to be taken by" or against the city or any agency thereof, rather than by or against the State Tax Commission Commis-sion in performing the functions func-tions incident to the administration adminis-tration or operation of this ordinance. ordi-nance. (3) If an annual license has been issued to a retailer under Section 59-15-3 of the said Utah Code Annotated 1953, an additional addi-tional license shall not be required re-quired by reason of this section. (4) There shall be excluded from the purchase price paid or charged by which the tax is measured: (A) The amount of any sales or use tax Imposed by the State of Utah upon a retailer or consumer; con-sumer; (B) Receipts from the sale of tangible personal property upon which a sales or use tax has become due by reason of the same, transaction to any other municipality and any county in the State of' Utah, under a sales or use tax ordinance enacted by that county or municipality in accordance with the Uniform Local Sales and Use Tax Law of Utah. Section 5. Use Tax. (a) An excise tax is hereby Imposed on the storage use, or other consumption con-sumption in this city of tangible personal property from any retailer re-tailer on or after the operative date of this ordinance for storage, stor-age, use or other consumption in the city at the rate of one half of one per cent (y2) of the sales price of the property. (b) (1) Except as hereinafter herein-after provided, and except insofar inso-far as they are inconsistent with the provisions of said Uniform Local Sales and Use Tax Law of Utah, all of the provisions of Chapter 16, Title 59, Utah Code Annotated 1953, as amended and in force and effect on July 1, 1959, applicable to use taxes, excepting ex-cepting the provisions of Section Sec-tion 59-16-1 and 59-16-25 thereof, there-of, and excepting for the amount of the tax levied therein, are hereby adopted and made a part of this section as though fully set forth herein. (2) Wherever and to the extent ex-tent that in said Chapter 16 of Title 59, Utah Code Annotated 1953, the State of Utah lsi named or referred to as the taxing agency, the name of this city shall be substituted therefor. Any person violating any of the pro visions of this ordinance shall be deemed guilty of a misde meanor, and upon conviction thereof, shall be punishable by a fine in an amount less than $300.00 or imprisonment for a period of not more than six months, or by both such fine and imprisonment. Section 7. Severability. If any section, subsection, sentence, clause, phrase, or portion of this ordinance, including but not limited to any exemption is for any reason held to be invalid or unconstitutional by the decision de-cision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. ordi-nance. On Thursday, "the same evening, eve-ning, a reception honoring the couple was held in the Alpine Ward Church. The bride was dressed in a regal gown styled out of mirror mist fabric with a fitted bodice which dipped to a point in the center front. The gown had a high neck line with a row of self covered buttons as the trim, the full pleated skirt was enhanced en-hanced by a chapel train and the crown of seed pearls held the elbow length veil of sheer illusion. She carried a white nrrhlrt Riirmnnrtpd hv talisman roses and stephanotis. Matron of Honor was Mrs. Clealon Mann, and bridesmaids Ferrell Walker, Miss Lily Vance,. Miss LaRue Hoyte and Connie Phillips was flower girl. These attendants all wore shaded orange or-ange plaid cotton sheath dresses and carried baskets of Esther Reed white daisies tied with green ribbon. Mother of the bride chose a pale green sheath .while the grooms mother wore a beige sheath with a lace jacket. Both mothers wore matching corsages of talisman roses. Standing with the groom as best man was Floyd Aldredge and Lanny Walker, Elmo Phil- line TXiivVa ao frtn an1 flAolvn Mann acted as ushers. Framing the wedding party-was party-was a latice work holding bird cages with arrangements of tangerine carnations and intertwined inter-twined with ivy. The color scheme of the wedding was white, orange and yellow In varying shades. The .beautiful, three telr cake was decorated with talisman roses with bud vases on either side of the cake holding the same roses. Mrs. Burke Heaton was at the guest book. Mrs. Elmo Phillips and Mrs. Dilworth White were in charge of the buffet refreshments. refresh-ments.
