In pursuance of the authority granted by 15-8-89 to 107 Inclusive, Utah Code Annotated, An-notated, 1943,. to provide for ionlng and the establishment of ; jUstrlcts within the corporate limits: to regulate, within such districts the , location, height, bulk, number of stories and size of buildings and structures, the erection, construction, recon- itructlon, alteration and repair - thereof, the percentage of lot oc- cupancy, the required open spaces, the density of population and the uses of land, buildings and structures; to provide meth ods of administration oi this ordinance, methods of enforce ment, and. penalties for the vlo lfttlon thereof. BE IT ORDAINED BY THE CITY COUNCIL OP AMERICAN FORK CITY AS FOLLOWS: ARTICLE I. ADMINISTRA TION AND ENFORCEMENT. Sec L Purpose, Interpretation, nd Conflict. (1) The purposes of this ordinance or-dinance are to promote health, safety, morals, and the general welfare of American Fork City, and, to these ends, to protect the health of its Inhabitants, to encourage the most appropriate use of land within the city, to Insure the value of property, to lessen the congestion In the streets' and ways, to avoid undue concentration of population, to - - facilitate adequate provisions for transportation, water, sewerage, schools, parks, and other public requirements, to provide an adequate ade-quate supply of light and air by regulating the location, use, and height of buildings and the area of open spaces about them, and to reduce, the hazard from fire. (2) In interpreting and ap plying the provisions of this or- dinanee, the requirement con tained herein are declared to be the minimum requirements for the purposes set forth. (3) This ordinance shall not nullify the more restrictive pro- visions of covenants, agreements, othef, ordinances.or..laws. .... but shaU.j)reval ,J notwithstanding such Vrovislons 'which "are less' restrictive. Sec. 2. Enforcement. (1) The' Building Inspector, appointed under the provisions of the Building Code of American Ameri-can Fork City, is hereby designated desig-nated and authorized as the officer of-ficer charged with the enforce- ' ment of this ordinance. (2) From the time of the - effective date of this ordinance, the Building Inspector shall not grant a permit for the construction construc-tion or alteration of any build ing or structure if such construe tion or alteration would be In violation of any of the provisions of this ordinance; nor shall any , municipal officer grant any permit per-mit or license for the use of any building or land if such use would be in violation of any, of ' " the provisions "ot thisordinance, except that a one-family dwelling dwell-ing may be constructed on any lot or parcel of land which Is recorded in separate ownership or which is subject to a contract In full force and effect at the1 time of he passage of this ordl-f nance. (3) whenever such permit is refused because of the violation of some provisions of this ordinance, ordi-nance, the reason for such refusal re-fusal shall be clearly stated in writing by the Building Inspector. Inspec-tor. (4) Every applicant for a permit per-mit for any construction, altera- - tion, or use of any building or land for which a permit is required re-quired by law shall, upon request of the Building Inspector, file such written Information, plans, specifications, or other such data as shall be deemed necessary for the. full and accurate, exposition of the proposed construction, alteration al-teration or use with relation to the regulations of this ordinance. Such material shall be kept on file in the records of the office of the Building Inspector. (5) The' Building Inspector, upon information in writing from any citizen, or upon his own lni-tiative, lni-tiative, may institute any appropriate ap-propriate actions or proceedings, whether criminal, civil or both, in the name of American Fork City to punish, prevent, correct, Tmramro this ordinance. (6) Building Permits Already Granted, Nothing In this ordinance ordi-nance shall require any change in the construction, size, or designated use of a building or structure for which a building permit has been legally granted . before the enactment of this ordinance, and the construction of which building shall have been started within ninety (90) days of such, enactment; except that if such building operation Is discontinued dis-continued for a period of six (6) Months, any further construction construc-tion shall be In conformity with the provisions of this ordinance. Sec. 4. The Board of Adjustment. Adjust-ment. (1) The Board of Adjustment established under the provisions of the Planning Ordinance of American Fork City shall constitute consti-tute the Board of Adjustment hereby established under this ordinance. or-dinance. This Board shall act In accordance with and pursuant o the powers and duties as prescribed pre-scribed by Statute and as provided provid-ed hereinafter. (2) Rules. The Board of Adjustment Ad-justment shall adopt such rules, not in conflict with laws or ordinances ordi-nances of the city, as may be proper and necessary to effectuate effectu-ate zoning within American Fork City and to govern its own proceedings. pro-ceedings. (3) Meetings. Meetings of the Board of Adjustment shall be held at the call of the chairman chair-man and at such other times as the Board in its rules of nro. cedures may specify. The chair man, or in nis absence, the acting act-ing chairman, mav administer oaths and compel the attendance oi witnesses. All meetings of the Board of Adjustment shall 'be open to the public. The Board shall keep minutes of its proceed ings showing the vote - of each member UDon each Question, or if absent or failing to vote, In aicating such fact, and shall keep records of its examinations and other official actions, all of which shall be immediately filed In the office nl the Board, and shall be a public record, The Board mav adopt supplemental rules of procedure not inconsistant herewith. (4) Appeals to the Board of Adjustment may be taken by any person or by any citizen, officer, department, board or bureau of the city affected by the grant or refusal of a building permit, or by other decision of an administrative adminis-trative officer or agency based, on or made In the course of the administration or enforcement of the provisions of the Zoning: Ordinance. The time within which such appeal must be made shall be reasonable, and the form or other procedure relating relat-ing thereto, shall be specified by the Board. The Builfllng Inspector Inspec-tor shall forthwith transmit to the Board all papers constituting constitut-ing the record upon which the action appealed from was laxen. The Board shall fix a reasonable time for the hearing of the appeal, ap-peal, give public notice thereof by publication of notice at least five days prior to the date of the hearing, as well as due notice to the narties in interest, and de cide the same within a reason able time. The concurring vote of three out of the five members of - the Board shall be necessary to reverse re-verse any order, requirement, or determination of any such administrative ad-ministrative official, or to decide in ravor of the applicant on any matter on which it Is required to pass or to effect any such varia uon in the application of this ordinance. (6) Review by Court. Any person aggrieved by any decision or tne Board of Adjustment may have the decision of said Board reviewed by a court of competent Jurisdiction. Sec. 5. Special Permits by the Board of Adjustment. (1) The Board of Adjustment may, in appropriate cases, after public notice and hearing, and subject to appropriate conditions and safeguards, determine and vary the application of the regulations regu-lations herein established In har mony with their general purpose and intent as follows a. Where a district boundary line divides a lot In single owner ship at the time of the passage of this ordinance, permit a use authorized on either portion of such lot to extend to the entire lot but not more than fifty (50) feet beyond the boundary line of such district In which such use is authorized. b. Permit the extension of an existing non-conforming build ing and the existing non-conforming use thereof upon the lot occupied by such building at the time of the passage of this1 ordinance. . - c. Permit a building to face on a side or rear yard. Sec. C. Amendments to the Ordinance and to the Zoning Map. In each Instance where any pnkm shall desire "to have such changes made, petition peti-tion shall be made to the City Council definitely setting out such request and particularizing the change desired. Such petition, peti-tion, together with any protests thereto, shall be referred to the Zoning Commission for consideration consid-eration and recommendation. The. City Council shall .call a public hearing before making Its own decision, and shall keep records of the recommendations of all of the citizens In regard to the proposed change. In case of a protest against the change, signed by the owners of twenty (20) per cent of the area of the lots Included In such proposed change or of those Immediately adjacent In the rear thereof extending ex-tending one hundred (100) feet therefronr or those- directly opposite op-posite thereto extending one hundred (100) feet from the street frontage of such opposite lots, such amendment or change shall not become effective except by a favorable vote of at least three-fourths of all the members of the City Council. Sec. 7. Areas Annexed to the City. New areas added or annexed to American Fork City shall take the classification of the district already within the city which has the longest abutting contact with the area so added or annexed. SecS. Notice. Amendments to, or changes In, this ordinance shall be adopted only after a public hearing In relation thereto before tne city Council, In which parties In In terest and citizens shall have an opportunity to be heard. Notice of the time and place of such hearing shall be given by at least one (1) publication of Notice In a newspaper of general circulation circula-tion within the city, printed at least fifteen (15) days prior to the time of such hearing. , ARTICLE n. DEFINITIONS For purposes of this ordinance, certain words are defined as follows: Any words not defined herein shall be construed as de fined In the Building Code of American Fork City if defined therein. CORNER LOT: A lot fronting on two or more Intersecting streets, each of which Is at least twenty (20) feet wide the front lot or street line ex tending across the full width of the lot. A corner lot, includes In addition, the area between the side line of the building (exclusive (exclu-sive of steps), adjacent to the street, and the side line or street line and extending the full depth of the lot . GARAGE, PRIVATE: An accessory ac-cessory building for the parking or temporary storage of automobiles, auto-mobiles, tut which does not Involve In-volve commercial repairing. . On a lot with a dwelling, a garage shall be considered a part of the dwelling If the two structures have one ox more walls or a roof In common. Where a garage Is thus part of a dwelling it shall ttqulre-lheAanMLsldft -yard asa dwelling in the same district. Where a garage is not a part of a dwelling, It shall be considered an accessory building. OARAGE, PUBLIC: .A build ing other than a private garage ment of automobiles, or where such'Tehicles are kept for ""remuneration, ""re-muneration, hire, or sale. ORADE: The average of the finished ground level at the center of all walls of a building. In case walls are parallel to and within five (5) feet of a sidewalk, the above ground level shall be measured at the sidewalk. HOME OCCUPATION: The use of a room within a dwelling as an office, studio, or work room for occupation at home by a person residing on the premises, but which does not Involve the purchase and resale of goods or commodities upon the premises. No sign other than a name-plate not more than two square feet In area shall be displayed which will Indicate from the street that a portion of the building Is being used for any purpose other than that of- a dwelling; HOUSEHOLD PETS: Animals or fowls ordinarily permitted in the house, and kept for company or pleasure, such as dogs, cats, canaries, etc. INTERIOR LOT: A lot other than a corner lot. LOT: A parcel of land oc cupied, or which may be occupied, Dy a Duiiaing ana its .accessory buildings, Including such open spaces as are required under this ordinance, and having irontage upon a street or alley. MAIN BUILDING: Any dwell ing or principal or dominating building located upon a lot, including in-cluding the following: apart ment house, hotel, public build ing, utility building, hospital, clinic, mortuary, church, library, museum, club, fraternal society and similar buildings. MAP: The .zoning map of American Fork City, Utah, as approved by this. ordinance, with any duly approved changes or alterations. - MULTIPLE DWELLING: A building arranged, intended or designed to be occupied by three of more families, but not Including Includ-ing hotels or tourist cabins. NON-CONFORMING USE: A building or land -lawfully occupied occu-pied at the time this ordinance became effective by a use that reference as much a part ef this ordinance as u fully described and detailed herein. The said map shall be filed In the custody of the City Clerk of American Fork and may be examined by tne public subject to any reason able regulations established by the city Clerk. (2) Where uncertainty exists as to the boundary of any dis trict, as hereby established and as shown on the map, the tol lowing rules shall apply: a. Where the designation on the map indicates that the boun dary line falls along a street or auey, tne center line of the street or alley shall be construed as the boundary. b. Where the district boun dariesrejriotthe.rwlse lndl cated and where the Indications on the map are approximately bounded by lot lines, the nearest lot line shall be construed to be the boundary of such district c. Where land has not been subdivided Into lots -and blocks the boundary line shall be determined de-termined by worthraeatt w measurement shown on the map. d. Where other uncertainty exists as to the boundary of any district, the Board of Adjustment shall Interpret the map. (3) It shall be unlawful for any person to erect, construct establish, alter, move, add to, or enlarge, or to cause or permit to be erected, constructed, establish ed, altered, moved, or enlarge, or to use or occupy or permit to oe used or occupied, any land, build ing, or premises for any purpose or In any manner contrary to this ordinance. ARTICLE IV. USE, AREA. FRONTAGE, YARD, AND HEIGHT REGULATIONS, See. 1. Residential District 1 (R-l) (1) Use Regulations. building or land shall be used. and no building shall be erected which Is arranged, Intended or designed to be used for 1 other than one or more of the follow ing uses: a One and two family dwell lngs. b. 8chools, churches, libraries, museums and other public build lngs provided there are no storage stor-age yards or repair shops and that no unreasonable noise, vi bratlon, fumes, etc. are emitted. c. Public parks, public recreation recrea-tion grounds and play grounds but not Including privately own' ed commercial amusement parks or recreation grounds. d. Agriculture, except animals or fowls, provided that any law ful use of buildings or land at the time of the passage or this ordinance may be continued. . e. Accessory buildings, lnclud lng a private garage for not more than three (3) cars; guest houses where no cooking facilities are provided and where the rooms are not for rent or hire; green houses for private use only, but not as business; and similar ac cessory buildings. f. A signboard not exceeding eight (8) square feet In area, appertaining ap-pertaining to the lease of sale of the property, also a bulletin for- any man building shall be not less than eight (8) feet and the total width of the two re quired side yards shall be not less than twenty, (20; feet Accessory Ac-cessory buildings shall have a side yard of not less than one (1) foot on corner lots, tne side yard which faces on a street shall be no less than twenty (20) feet for both main and accessory buildings. No accessory building shall be located closer than fif teen (15) feet to any dwelling on an adjacent lot - b. Front Yard. The minimum set-back for main buildings shall be thirty (30) feet The minimum set-back line for accessory buildings shall be at least six (8) feet in the rear of the main building. Where no main building exists on a lot accesory buildings shall be located lo-cated at least sixty (60) feet from the front lot line, c. Rear Yard. " The minimum rear yard for any main building shall be twenty-five (25) feet The minimum min-imum rear yard for accessory buildings shall.be one (1) foot (3) Height Regulations. SIDE YARD: An open unoccupied unoc-cupied space on the same lot with a building, between the side-line of the building (exclusive of the premises of a church or oth er institution for the purpose of displaying the name and actlvl ties of services therein, provided that such bulletin must be set within two (2) feet of the build ing lines. (2) Area Regulations. The minimum building site shall be not less than six thousand thous-and (6,000) square feet in area for each one-family dwelling, or seven thousand (7,000) square feet for each two-family dwell ing. , (3) Frontage Regulations, . The minimum width of any building site for a dwelling shall be sixty (60) feet at a distance thirty (30) feet back from the front lot line. (4) Yard Regulations. . ' The minimum building site shall be not less than six thous and (6,000) square feet In area for each one-family dwelling, and one thousand (1,000) 'addi tional square feet for each add! tlonal family unit. Accessory buildings build-ings shall have a side yard of not less than one (1) foot. On corner lots, the side yard which faces on a street shall be not less than twenty (20) feet for both main and accessory buildings. No accessory ac-cessory building shall be located closer than fifteen (15) feet to any dwelling on an adjacent lot. b. Front Yard. (2) Area Regulations. The minimum building - site . shall be not less than six thous- . The minimum width of any building site for a dwelling shall be sixty (60) feet at a distance thirty (30) feet back from the front lot line. (4) Yard Regulations. ) a. Side Yard. The minimum side yard tor any dwelling or other main building shall be one-half the distance from the grade to the elevation of the square of the building except ex-cept that the minimum side yard for any main building shall be not less than eight (8) feet and the total width of the two required re-quired side yards shall be not less than twenty (20) feet . Ac cessory buildings snail nave a side yard of not less than one (11-i.foet; onr.cornerKaots,ie . side yard which faces on a street shall be not less than twenty (20) feet from both main and accessory buildings. No acces- sory building shall be located closer than fifteen (15) feet to any dwelling on an adjacent lot b.. Front Yard. ? The minimum set-back for main buildings shall be thirty - (30) feet The minimum set back line for accessory buildings shall be at least six (8) feet In the rear of the main building. Where no main building exists on a lot accessory buildings shall be located at least sixty (60) feet from the front lot line. , c.
