The Orem City Council voted 5-0 September 4th to establish development criteria for such uses by adopting the Urban Mixed Use Overlay Zone. In presenting the new overlay over-lay zone, Development Sendees Director Stan Sainsbury said mixed uses constitute one of the elements of the city's-recently-updated General Plan. The overlay zone, he said, does not take away any of the "rights" of the underlying zone. The minimum urban mixed use overlay zone size will be three acres. Mayor Jerry Washburn said residential areas are insulated from the effects of the zone, because it will be limited to being used on State Street and in some areas by the freeway. Sainsbury said city planners did not limit housing to any one use, because they could see lots of options, such as a "mom and pop" store situation, where the owners could run a store and live upstairs. The housing will not be geared toward students, but more toward single families and young professionals. Councilmember Karen McCandless said that as a planner, she is very interested in mixed uses. She asked Sainsbury if he could envision Sandhill Road parcels that could have mixed uses. "We need to see all the possibilities the overlay could do," she said. Councilman Les Campbell said he is always concerned about commercial uses creeping creep-ing into residential areas, but observed that to him, "this is the opposite," with the housing protecting business, and the business protecting housing. "Where this is even feasible," said Councilman Joseph Andersen, "is State Street, which makes sense for urban renewal. That's what gives it safety, is the location." Standards of the zone include the following: Building heights and setbacks set-backs are determined by the standards of the underlying zone. To mix residential and commercial uses, the main floor is used for retail and office uses only, with the upper floors then used for either commercial or residential units. Parking is based on a building's commercial floor space and the parking standards stan-dards of the underlying zone. Residential parking requires three parking stalls per unit. The number of residential units is restricted by the amount of parking provided. So-called "carriage houses" can now be built in Orem. The Orem City Council voted 5-0 September 4th to change the city code governing accessory building setbacks. Added to the law is language which now states that accessory accesso-ry buildings or structures can be constructed between the primary pri-mary structure and the side property line which is not adjacent adja-cent to a street if they do not cover more than 159c of the required side yard setback area, and do not exceed 18 feet in height or the height of the primary structure (whichever is greater). Councilman Stephen Sandstrom, an architect, said he thought the ordinance change was "long overdue". A detached garage, or "carriage house", enhances the look of property, he said, and local builders have been "upset" about not having this option available. The change should not create a problem, he said, because the structures will be going in on buildable area. Sandstrom explained that the accessory buildings were previously not as big an issue, but have become a "phenomenon" "phenome-non" the past few years, as larger lots have been developed. devel-oped.
