Show Legal Ordinance No. 322 Aa Ordinance of the City of Orem, Utah providing tor the pur-ehaie pur-ehaie of supplies, materials, equipment and contractual service!, ser-vice!, ni the disposal ol public property. The City Council of the City of Orem does hereby ordain as follows: Established Provisions Pursuant to Sections 10-7-20, 10-8 2 and other pertinent provisions of the laws of the State of Utah, there is hereby adopted and establihsed a Purchasing Pur-chasing System for the Orem City Corporation which shall be based on the following principles and provide for: Sectioa I Definitions Unless the context requires otherwise, the terms as used in this ordinance, or the rules and regulations adopted pursuant to this ordinance shall have the following n'eanings: (a) "Supplies", "Material" and "Equipment" any and all articles ar-ticles or things which shall be furnished fur-nished to or used by any City department. b( "Contractual Services" -public works projects and other professional services such as auditing, architects, engineers or other consulting services. :- el "Bidding" procedure used to solicit quotations on price and delivery from various prospective suppliers of supplies, equipment, contractual services. Id) "Responsible Bid" - an offer, of-fer, submitted by a responsible bidder to furnish supplies, equipment equip-ment or contractual services in conformity with the specification, delivery terms and conditions, and other requirements included in the invitation for bids. (e) "Responsible Bidder" - a bidder who submits a responsible bid; who has furnished, when requested, information and data to prove that his financial resources, production or service facilities, service reputation and experience are adequate to make satisfactory delivery of the supplies, equpment, or contractual services on which he bids; and who has not violated or attempted to violate a provisions of this ordinance. , If) "Local Bidder" - a ifcm or individual who regularly maintains a place of business and transacts business in, or maintains an inventory inven-tory of merchandise for sale in, or is licensed by, or pays business taxes to, the City of Orem. Ig) "Estimates of Requiremen-raents" Requiremen-raents" forecasts of future requirements re-quirements of supplies, equipment, or contractual services submitted by City departments upon request of the City Manager or his designee. (h) "Requisitions" - standard forms used by departments providing detailed information as to quantity, description, estimated price, recommended supplier, and signature authorization for requested purchases. (it "Purchase Orders" - official document used in committing City funds toward the purchase of supplies, sup-plies, equipment and contractual services. Ij) "Adequate Appropriation Balance" - Sufficient fund balance which must exist in the line item appropriation of the account number num-ber against which the purchase order is to be charged. (1) "Public Property" - Any item of real or personal property owned by the City. Section 2 Administration The City Manager or his designee shall administer the Purchasing Pur-chasing System provided by this chapter. By the statutes provided herein and by other applicable laws he shall Derform the duties TRiasnrt'iniPAirrMKXi A ' ' ,rjfJ.?'f 7tf'r?: "a k i A A 4 r 7 and have powers concerning purchasing pur-chasing matters as follows: (a) Administer and maintain the purchasing system and other rules and regulations established by this chapter and its authority. (b) Recommend to the City such new or revised purchasing rules and regulations as deemed desirable and in conformance with other statutory requirements, and to interpret the provisions of this chapter and applicable statutes. (c) Negotiate and recommend execution of contracts for the purchase pur-chase of supplies, equipment and contractual services. (d Seek to obtain as full and open competition as possible on all purchases. (e) Keep informed or current developments in the field of purchasing, pur-chasing, i.e. prices, market conditions, con-ditions, new products, etc. (f) Prescribe and maintain such forms as reasonably necessary to the operation of this ordinance and other rules and regulations. (g supervise the inspection of all supplies and equipment to assure conformance with specifications. (h) Transfer surplus or unused supplies and equipment between departments as needed. (i) Maintain a Bidders' List, Vendors' Catalog file and other records needed for the efficient operation of the Purchasing System. Section 3 Competitive Bidding Requirements Re-quirements Except as hereinafter provided, purchases of supplies, equipment and letting of contracts shall follow one of the following procedures: (a) Formal Contract Procedure Except as otherwise provided herein, purchases of supplies, equipment or contractual services of an estimated value greater than $2,000 shall be by written contract con-tract with the lowest responsible bidder pursuant to the procedure hereinafter prescribed. (1) Approval of Specifications Prior to seeking bids for equipment or contractual services having a unit cost in excess of $2,000, action of the City Council shall be required to approve specifications and to authorize advertising ad-vertising for bids. 12) Notice Inviting Bids Notices inviting bids shall include a general description of the article: ar-ticle: to be purchased, shall state where bid blanks and specifications may be secured, and the time and place for opening bids. la) Published Notice Notices inviting bids shall be published at least ten (10) days before the date of the opening of the bids. Notices shall be published at least once in a newspaper of general circulation printed and published in the City. lb) Bidders' List Sealed bids shall be solicited from all responsible respon-sible prospective suppliers whose names are on the Bidders' List or who have made written request that their names be added thereto. c Bulletin Board Notices advertising ad-vertising pending purchases slyill also be posted on a public bulletin board in the City Hall. 3 Bid Opening Procedure Sealed bids shall be submitted as designated in the Notice with the statement "Bid for (item)" on the envelope. Bids shall be opened in public at the time and place stated in the public notice. A tabulation of all bids received shall be open for public inspection during regular business hours for a period of not less than thirty (30) days after af-ter the bid opening. (4) Rejection of Bids In its discretion, the City Council may reject without cause any and all bids presented and re-advertise for bids pursuant to the procedure hereinabove prescribed. (5) Award of Contracts Except Ex-cept as otherwise provided herein, contracts shall be awarded by the nlUPni,U "FIRST SECURITY OREM 4 Published in the Orem and 20, 1977. f 'A 4 -Yjf j i "V m City Council to the lowest responsible respon-sible bidder, 161 Tie Bids If two or more bids received are for the same total amount or unit price, quality and service being equal, and if the public interest will not permit the delay of re-advertising for bids, thn City Council shall accept the lowest bid made by and after negotiation with the tie bidders at the time of the bid opening. 171 Performance Bonds Before entering a contract the City Council Coun-cil shall have authority to require a performance bond in such amount as it shall find reasonably necessary to protect the best interests in-terests of the City. The form and amount of said bond shall be described in the notice inviting bids. lb) Open Markert Procedure Purchases of supplies, equipment equip-ment or contractual services of an estimated value in the amount of $2,000 or less may be made in the open market pursuant to the procedure hereinafter prescribed and without observing the procedure prescribed in Section 3(a) hereof; provided, however, all bidding may be dispensed with for purchases of supplies, equipment or contractual services having a total estimated value of less than $100. ID Minimum Number of Bids Open market purchases shall, whenever possible, be based on at least three bids (price quotations) and shall be awarded to the lowest responsible bidder. 12) Solicitation of Bids. Bids (price quotations) shall be solicited from prospective vendor by written writ-ten or telephone requests. let Trofessional Service Contracts Con-tracts P-ycedure Contracts for professional services shall be awarded at the discretion of the City Council to include, but not limited to, the following services: auditing, banking, insurance, engineering, architects. (1) Award of Contracts Contracts Con-tracts shall be awarded at the discretion of the City Council based on the evaluation of professional qualifications, service ability, cost of service, and other criteria deemed applicable by the City Council. Section 4 Exemptions to Competitive Com-petitive Bidding Requirements Is) Contracts which by their nature are not adapted to award by competitive bidding, such as contracts for items which may only be purchased from a single soi ree, contracts for additions to an 1 repairs and maintenance of equipment owned by the City which may be more efficiently added ad-ded to, repaired or maintained by a certain person or firm, contract for equipment which, by reason of the training of the personnel of or an inventory of replacement parts maintained by the city is compatible com-patible with the existing equipment equip-ment owned by the City shall not be subject to the competitive bidding bid-ding requirements of this ordinance. ordi-nance. If the City Manager determines that supplies, materials or equipment can be purchased at any public auction, closeout sale, bankruptcy sale or other similiar sale, and if a majority of the City Council at a regular or special meeting occurs in such determination and makes a finding that a purchase at any such auction or sale will be made at a cost below the market cost in the community, a contract or contracts con-tracts may be let, or the purchase made, without complying with the competitive bidding requirements of this ordinance. (1) Exchanges of supplies material or equipment between the City and any other public agency which are not by sale or auction shall be by mutual agreement of the respective public agencies. Section 5 Interlocal Agreements In Letting Of Contracts For Commodities Com-modities Or Services The City shall have the power the enter into joint purchase agreements with any or all other public agencies within the state for the purchase of any commodity or service wherein it is determined by the City Council to be in the best interest of the Citv. Section 6 Disposal Or Lease Of Public Property All disposals, leases, and or subleases of public property of the City shall be made, as nearly as possible, under the same conditions con-ditions and limitations as required by this ordinance in the purchase of public property, but the City Council may also authorize, at its discretion, (a) the sale of any such purchase pur-chase at public auction if it deems such a sale desirable and in the best interest of the City, or (b) the lease or sublease of any such property at a properly advertised adver-tised public hearing under such terms and conditions as it may deem are desirable, fair, and appropriate ap-propriate considering intended land use and equivalent property tax value, and in the best interest of the City. Section 7 Penalties (al Conflicts of Interest No member of the City Council or city employee may be interested directly direc-tly or indirectly in any contract entered into by the City. A violation vio-lation of this provision shall be cause for removal or other disciplinary action. lb) Collusion Among Bidders Any agreement of collusion among bidders or prospective bidders in restraint of freedom of competition com-petition by agreement to bid a fixed price, or otherwise, shall render ren-der the bids of such bidders void. Ic) Advance Disclosures any disclosure in advance of the opening of bids, whether in response to advertising or an informal in-formal request for bids, made or permitted by a member of the City Council or City employee shall render void the advertisement or request for bids. Other personal purchases shall not be permitted and will be the cause for the disciplinary action. Section 9 Severability If any section, subsection, subdivision, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or otherwise invalid, such invalidity in-validity shall not affect the validity of the entire ordinance or any of the remaining portions thereof. The City Council hereby declares that it would have passec this ordinance, and each seciton, subsection, subdivision, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses or phrases be declared unconstitutional uncon-stitutional or otherwise invalid.
