Mr. Elder, the plaintiff, filed the suit as a test case for the Association in which he named his boss, Sherman J. Preece, the state auditor; Utah Gov. Calvin L. Rampton; Secretary of State Clyde L. Miller; Attorney General Vernon B. Romney, and Edward T. Himstreet, State Personnel Per-sonnel director. Republican Congressional Candidate, . Bob Wolthuls addressed add-ressed the Orem Republican Womens Club in the Orem City Hall Wednesday Evening August 16 on the subject of Legislative procedure. Mr. Wolthuls spoke out on the issues of Revenue Sharing. 1 do now and I have always favored this vital concept as a start in bringing government closer to people.' he said. "If adopted, this measure would represent a 144 return to the state of Utah for every dollar spent. Mr. Wolthuls commented onhis Republican opponent's endorsement endorse-ment of American Independence Party presidential candidate, Lame-duck congressman, John Schmitz, Republican from California; Calif-ornia; "I think it's unfortunate that Mr. Ferguson has used the Republican party for hisownpur-poses, hisownpur-poses, has criticized the President, Presi-dent, and then bolted the party to support the candidate of another ticket, he said. Mr. Wolthuls reemphasized his 'enthusiastic endorsement of President Nixon. In speaking about the need for a Republican Congress, Mr.Wolthuiscriticized his democratic opponent, Re-resentative Re-resentative Gunn McKay, democrat demo-crat for Utah, for his 'Voting Credibility Gap." 'My opponent has voted to give food stamps to Strikers, to keep dock-strike legislation off the House floor, and has earned 92 liberal union raing," he saidI can't believe this is representative of Utah's First District. He alleged that he submitted his application as a candidate for state auditor May 10, 1972 and that Mr. Preece allegedly terminated Mr. Elder's employment. employ-ment. UPEA Executive Director Rick Kinnersley said, 'That the Association has taken this action because it believes it is time to end policies and practices that continue to place public employees in the role of second class citizens. UPEA believes that the present restrictions prohibiting state employees from running for political office are inequitable and highly discriminatory," Kinnersley Kin-nersley said. According to Mr. Kinnersley "Higher education employees, public school personnel and many others are allowed to continue their employment until elected, or in the case of legislators, until called into session. "State employees must, in effect, resign their positions as soon as they file for office, he said. "We are not advocating allowing allow-ing public employees to use their positions to camapign for public office by the action UPEA has taken, Kinnersley said. Association officials are hopeful hope-ful that courts will find in favor of Mr. Elder. The burden of responsibility lies on the state to prove that it is more important to deny an individual their constitutional con-stitutional rights than to allow them to run for public office.
