R-3 Residential Zone. SEC. 29-3-3a-l. Objectives and Characteristics Charac-teristics of Zone. The objective in establishing the R-3 Residential Zone is to provide appropriate locations within the city for high density residential development. In general, gen-eral, this zone is located in the central part of the city, adjacent to commercial areas where the impact of vehicular travel and parking is consonant with adjacent ad-jacent use of land, and where multiple dwellings can best be supplied with necessary public facilities. The zone is characterized character-ized by more compact development develop-ment and somewhat higher volumes vol-umes of traffic than is characteristic character-istic of the R-l and R-2 Zones. Representative of the uses within the R-3 Zone are one, two three and four-family dwellings and apartment houses, and related re-lated community facilities. However, How-ever, commercial and industrial uses are prohibited therein. Owners and developers of property pro-perty should bear in mind that primacy is given to multiple family dwellings, boarding houses, rest homes and other high density residential uses, and should develop and maintain their property in recognition thereof. In order to accomplish the objectives and purposes of this Ordinance, and to preserve the characteristics of this Zone, the following regulations shall apply in the R-3 Residential Zone: SEC. 29-3-3a-2. Use Requirements. A. Permitted "Non-conditional Uses. Permits for the following build ings, structures, and uses of land shall be issued by the zoning administrator upon compliance with the requirements set forth herein. 1. Any non-conditional use permitted per-mitted in the R-l and R-2 Residential Resi-dential 'ones. 2. Apartment Houses and other multiple dwellings. B. Permitted "Conditional Uses. Permits for the following con ditional uses shall be Issued by the Zoning Administrator only after approval thereof has been given by the Planning Comniis .sioii. Orem-Geneva Times - 1. Any conditional use permit ted in the R-l and R-2 Residential Residen-tial Zones. 2. Boarding and rooming houses, dormitories, fraternities, fraterni-ties, rest homes, convents, foster fos-ter family care homes and orphanages or-phanages with an unlimited number num-ber of guest rooms, , The peculiar character and nature of the foregoing conditional condi-tional uses require special consideration. con-sideration. Therefore, the Planning Plan-ning Commission's review of these conditional uses shall be made with the general purpose of guiding and accomplishing a coordinated, co-ordinated, adjusted and harmon-" ious development in accordance with existing and future needs. In granting approval of these conditional uses, the Planning' Commission shall consider, among other things, the character of the zone, the protection of property values, and the present and future requirements for transportation, traffic, water, and other utilities and public requirements. SEC. 29-3-3a-3. Area Requirements for Building Sites. An area of not less than sixty-five sixty-five hundred (6,500) square feet shall be provided and maintained for each one-family dwelling, and one thousand (1,000) additional square feet shall be provided for each additional dwelling unit. Schools, churches, boarding houses, and other main buildings shall have a building site area of at least sixty-five hundred (6,500) square feet, plus three (3) additional square feet for each additional square foot of floor ' space in the building in excess of one thousand (1,000) square feet. SEC. 29-3-3a-4. Frontage Requirements. . The minimum width of any building site for a dwelling or other main building shall be sixty-five (65) feet, measured at a distance of thirty (30) feet back from the front lot line. SEC. 29-3-3a-5 Location of Buildings and Structures. SEC. 29-3-3a-5-l. Front Setback. Main buildings shall be set back at least thirty (30) feet from the front lot line. The minimum setback for accessory buildings shall be thirty (30) feet, provided a side setback Is main' tained as required for main build ings; otherwise, the minimum setback for accessory buildings shall be six (6) feet in the rear of the main building. Where no main building exists on a lot, accessory buildings shall be lo cated at least sixty (60) feet from front lot line. SEC. 29-3-3a-5-2. Side Setback-Interior Lots. For interior lots, all dwellings and other main buildings shall be set back from the side property line a distance of at least ten (10) feet, and the total distance of the two side setbacks shall be at least twenty-four (24) feet, pro vided that the minimum side setback for dwellings and other main buildings having an attached I garage or car port may be re duced to six (6) feet, and the total distance of the two side setbacks may be reduced to six. teen (16) feet. The minimum setback set-back from the side property line for accessory buildings shall be the same as for main buildings if said accessory buildings are located less than six (6) feet in the rear of the main building. For accessory buildings to cated a distance greater than six (6) feet in the rear of the main building, no minimum side set back shall be required, provided the walls are constructed of fire resistive materials of two (2) hours or more. Accessory build ings having walls which are not constructed of such fire-resistive materials shall have a side setback of at least six (6) feet. No part of an accessory building shall extend beyond the property line. SEC. 29-3-3a-5-3. . Side Setback - Corner Lots. On corner lots the setback from the side property line for main buildings which are located adjacent ad-jacent to an interior lot shall be at least ten (10) feet for dwellings and other main buildings; build-ings; provided,however,the minimum mini-mum side setback for main buildings build-ings having an attached garage or carport shall be six (6) feet. For accessory buildings the minimum setback from the side property line which is adjacent to an interior in-terior lot shall be the same as the main building if the accessory acces-sory building is located less than fifteen (15) feet in the rear of the main building. For accessory buildings located a distance greater than fifteen (15) feet in the rear of the main building, no minimum side setback shall be required from the interior side property line, provided the walls are constructed of fire-resistive materials of two (2) hours or more. Accessory buildings having hav-ing walls which are not constructed con-structed of fire-resistive materials mater-ials shall have a setback of at least six (6) feet. SECTION VIII Any person violating any provisions pro-visions of this Ordance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished pun-ished by a fine in any sum not exceeding two hundred nlnty-nlne nlnty-nlne eoilars ($299.00), or by imprisonment for a period of thirty (30) days, or by both fine and imprisonment. Each and every day such violation shall be continued, shall be considered a separate offense. SECTION IX. Because of impending development develop-ment within Orem City, Utah, and wore particularly within the hind hereinabove described, an emergency emer-gency exists.
