The year's best party was put on by the Orem Chamber of Commerce, Orem City and the Scera organization. Over 3000 children enjoyed the huge Christmas gathering. The party was under the direction of Winston Crawford, Chamber president, with Dick Nelson, chairman. Below part of the crowd of happy children as they were about to enter the theater. License Dispute Aired By Mayor Mayor G. Milton Jameson met with City Manager Earl Wengreen in an attempt to clear up the controversy and misunderstanding misunderstand-ing which resulted from Orem City's statement that all delinquent delin-quent businesses will be required to pay the minimum license fee for 1963 and 1964, as well as the fee due under the new 1965 ordinance. or-dinance. Orem's old ordinance charged large businesses a license fee of one-half of one per cent of the total volume of sales or a maximum maxi-mum of $300; small businesses were required to pay a flat $25. The trouble began because the law was not enforced and some were paving the license fee and others were not. RULED INVALID In December of 1964 this old ordinance was ruled invalid by the Supreme Court in a test case of Orem City vs. Dee Pyne. Mr. Pyne, an automobile dealer, was charged the license fee required of large businesses he refused to pay and took the city to court The Supreme Court ruled the city ordinance' unconstitutional where it applied to Dee Pyne; they did not mention the $25 minimum fee charged to small businesses. MINIMUM FEE REQUIRED Since this minimum $25 fee was not affected by the Supreme Court decision the city council felt that those businesses which had refused to pay anything would be required to pay the minimum HELP WANTED-NEW WANTED-NEW plastic coating eliminates waxing. Under the statute of limitations, limita-tions, the city cannot charge the license fee back beyond 1963. Some businessmen had paid in good faith during the disputed period, and some had paid under protest, while others had paid more than the minimum fee. WHAT'S FAIR? The city council weighed all aspects carefully before making a decision. Mayor Jameson pointed point-ed out that the approximately $8,000 collected from businessmen business-men under the old law belonged to every taxpayer and could not be refunded. Also those who had Dald more than the minimum $25 during a particular year could not legally apply tne Daiance io the following year. Even though the amount paid was $25 oi $300, the payment met the requirements require-ments for that year only in which it was paid. Although this is unfair un-fair in many cases the city council coun-cil felt it was the most equitable decision possible. REFUNDS THIS YEAR Since the new ordinance did not become effective until May of 1965, any businessmen who nave already paid more than the minimum min-imum $25 license fee for this vear will have a balance refunded. No business will be required to pay more than the minimum fee dV s $4 for each additional em- Dlovce over ten for this year.
