Lincoln To Elect Officers April 18 Primary elections for -student body officers at Lincoln High were held this week. Student body president, Dean Adams, received petitions suggesting possible candidates. From these the student council chose candidates can-didates to run on two separate tickets. Following a vigorous campaign cam-paign by boosters of these candidates, can-didates, the entire student body will vote on April 18. President, Presi-dent, vice president, secretary, historian and judge for the coming year are to be elected. The Board of Adjust ment. (l! The Board of Adjustment Adjust-ment heretofore set up in connection con-nection with Ordinance No. 74 of the ordinances of Orem City shall serve as a Board of Adjustment Ad-justment in matters pertaining to this ordinance. (2) The Board of Adjustment Adjust-ment shall organize, elect a chairman, adopt rules of procedure, pro-cedure, and hold meetings at i the call of the chairman or at other times specified by the board. The chairman, or in his absence the acting chairman, may administer oaths and compel com-pel the attendance of witnesses. All meetings of the Board of Adjustment shall be open to the public. The Board of Adjustment Ad-justment shall keep minutes of its meetings, stiowing the vote of each member upon each question, or if absent or failing to vote showing such fact, and shall keep records of its examinations and other of ficial actions; all of which shall be immediately filed in the office of the Board of Ad justment and shall be a public record. (3) Appeals to the Board of Adjustment may be taken by anv person aggrieved or by any officer, department, board or bureau of the Orem City affected affect-ed by any decision of the administrative ad-ministrative officer. ; Such appeal ap-peal shall be taken within a reasonable time as provided by the rules of the board by filing fil-ing with the officer from whom the appeal is taken and with, the Board of Adjustment a notice no-tice of appeal specifying the grounds thereof. The Officer from whom the appeal is taken shall forthwith transmit to the Board of Adjustment all the papers constituting the re cord upon which the action appealed from was taken. Section 3. The Building Inspec tor. The building, inspector ap pointed under the provisions of the building code of Orem City shall be the officer charged charg-ed with responsibility for build ing permits under this ordinance. ordin-ance. Section 4. The Master Plan Adjacent Territory It shall be the function and duty of the Orem City Planning Commission, after holding public pub-lic hearings, to make, adopt, and certify to the Orem City Council a master plan for the physical development of the city. The master plan shall show the planning commission's com-mission's recommendations and may include, among other things, the general location, character, and extent of streets, narks, parkways, playgrounds, airports, and other public spaces: the general location and extent of public utilities and terminals, whether publicly or nrivately owned; the acceptance, accep-tance, widening, removal, ex-'ension, ex-'ension, relocation, narrowing, vacation, abandonment, or change of use of any of the foregoing; fore-going; the general location, character, layout, and extent of community centers and neighborhood neigh-borhood units: and the general character, extent, and layout of the re-planning of blighted areas. The Orem City Planning Plan-ning Commission may from time to time amend, extend, or add to the master plan or carry any part or subject matter mat-ter into greater detail. The Orem City Planning Commission may make, adopt. Snd certify to the Orem City Council in connection with the master plan for the physical development of Orem City, a plan for the physical development develop-ment of any area outside of the boundaries of Orem City which, in the planning commission's commis-sion's judgement, bear relation to the planning of Orem City. Where the plan involves territory terri-tory outside the boundaries of :he city, action shall be taken with the concurrence of the county or within the municipal legislative body concerned. Section 5. Supervision of the Operation of Adopted Plan. Whenever the Orem City Council shall have adopted the master plan for Orem City or any part thereof, then and thenceforth no street, park or other public way, ground, place structure, or no public utility, structure, and no public utility, whether publicly or privately owned, shall be constructed or authorized until and unless the location and extent thereof shall conform to said plan or shall have been submitted to and approved by the Orem City Planning Commission; provid ed, that in case of disapproval, the Orem City Planning Commission Com-mission shall communicate its reasons to the Orem City Council Coun-cil by a vote of not less than a majority of its entire membership, member-ship, shall have the power to over-rule such disapproval, and upon such over-ruling the Orem City Council shall, or the appropriate board or official offi-cial shall, have the power to proceed; provided, however, that if the public way, ground, place, space, building, structure, struc-ture, or utility be one the authorization au-thorization or financing of which does not, under the law governing the same, fall within with-in the province of the Orem City Council, or other body or officials of the City of Orem, then the submission to the Orem City Planning Commission Commis-sion shall be by the board or rfficial having such jurisdiction, jurisdic-tion, and planning commission's commis-sion's disapproval may be overruled over-ruled by said board by a vote of not less than a majority of its entire membership or by aid official. The acceptance, widening, removal, extension, relocation, narrowing, vacation, vaca-tion, abandonment, change of use, acquisition of land for, or sale or lease of any street or other public way, ground, place, property, or structure, shall be subject to similar submission sub-mission and approval, and the failure to approve may be similarly sim-ilarly overruled. The failure ot the Orem City Planning Commission Com-mission to act within thirty days from and after the date of official submission to it shall be deemed approval, unless a longer period be granted by ihe Orem City Council or other submitting body, Doard, or official. of-ficial. Section 6- Planning Commission's Commis-sion's Powers and Functions. In the preparation of the master plan, the Orem City Planning Commission shall make careful and comprehensive comprehen-sive surveys, and studies of the existing conditions and probable prob-able future growth of the Orem City and its environs. The plan shall be made with the general purpose of guiding and accomplishing a co-ordinated, adjusted, and harmonious development dev-elopment of the municipality which will, in accordance with existing and future needs, best promote public health, safety, or general welfare, as well as efficiency and economy in the process of development. The Orem City Planning Commission may make reports and recommendations relating to the plan and development ot the City of Orem to public officials of-ficials and agencies, and other organizations, and citizens. It may recommend to the mayor and Orem City Council programs pro-grams for public improvements and the financing thereof. In general, the Orem City Planning Plan-ning Commission, its members and employees, shall have such cowers as may be necessary to enable it to perform its functions func-tions and promote municipal nlanmng. Section 7. The Official Map Contents Modifications of. From and after the time when the Orem City Planning Commission shall have adopted a maior street plan of Orem City or any part thereof, the Orem City Council may establish estab-lish an official map of the whole or any part or parts of j Ihe city theretofore existing d established by law as public pub-lic streets. Such official man -"a v also show th location of 'he lines of streets on plats of subdivisions which shall have been approved by the Orem City Planning Commission. The Oreri City Council may make, from time to time, other addi--i'-ns to or modifications of the official maD by placing thereof the lines of proposed new streets or street extensions, widenings, narrowings, or vacations vaca-tions which have been accurately accurate-ly surveyed and definitely located; loca-ted; provided, however, that be fore taking any such action the city council of Orem City shall hold a public hearing thereon and provided, furthor, that such proposed addition to or modification modifi-cation of the official map shall be submitted to the Orem City Planning Commission for its approval, ap-proval, and in the event of such Orem City Planning Commission's Com-mission's disapproval, such addition ad-dition or modification shall re-quire re-quire the favorable vote or not less than a majority of the entire en-tire membership of the Orem City Council. The placing of any street or street lines upon the official map shall not in and of itself constitute or be deemed deem-ed to constitute the opening or establishment of any street or the taking or acceptance of any land for street purposes, Upon adoption, of the ordinance creating the official map, the Orem City Council shall direct that said ordinance be recorded in the office of the county recorder. re-corder. Section 8. Building Permits Restrictions on Issuance of. From and after the time wnen an official map has been recorded in the office of the County Recorder, no permit shall be issued by thp building inspector for any building or structure or part thereof on any land located between the mapped map-ped lines of any street as snown on the official map. Any person per-son aggrieved by his inability to obtain such a permit may appeal to the Board of Adjustment, Adjust-ment, herein impowered. The Board of Adjustment shall have the power, upon an appeal filed with it by the owner of any such land, to authorize the grant of a permit for a building build-ing or structure or part thereof there-of within any mapped-street location in any case in which the Board of Adjustment, upon the evident, finds (a), that the property of the appellant ,, of which such mapped-street location loca-tion forms a part will not yield a reasonable return to the owner unless such permit be granted, or (b) that, balancing balanc-ing of interest of Orem City in preserving the integrity of the official map and interest of the owner in the use and benefits bene-fits of the property, the grant of such permit if required by considerations of justice, and equity. Before taking any such action, the Board of Adjustments Adjust-ments shall hold a public hear ing thereon. In the event that the Board of Adjustment decides de-cides to authorize a building permit, it shall have the power to specify the exact location, ground area, height, and other details and conditions of extent and character and also the dur ation of the building, structure, or part thereof to be permitted. Section 9. Sub-division Restrictions Re-strictions on Filing of. - ' From and after the time when the Orem City Planning Commission shall have adopted a major street plan and shall have certified the same to the Orem City Council, no plat of a subdivision of land lying within Orem City shall be filed or recorded in the County Recorder's office until It shall have been submitted to and approved ap-proved by the Orem City Planning Plan-ning Commission and the Orem City Council, and sucn approval approv-al entered in writing on the plat by the secretary of the Orem City Planning Commission Commis-sion and the City Recorder of Orem City. No county recorder shall file or record a plat of a subdivision without such appro val, and any county recorder "o doing shall be deemed guil ty of a misdemeanor. The filing or recording of a plat of a sub division without such approval shall be void. The Orem City Planning Commission shall pre pare regulations governing the subdivision of land within the city. The Orem City Council hall hold a public hearing on 'he subdivision regulations, ann 'hereafter may adopt said regu lations for the city. Section 10. Violation, penalty. Injunction. Whoever being owner or a gent of the owner of any land located within any area of Orem City for which a major street plan has been adopted by the Orem City Planning Com mission and the Orem Jity Council, transfers or sells such land by reference to or exhibi tion of or by other use of a plat or subdivision of such land before such plat has been approved by said Orem City Planning Commission and Orem City Council and recorded record-ed in the office of the county recorder, shall forfeit and pay a penalty of one-hundred dol lars for each lot so transferred or sold, or agreed of negotiated to be sold; and the description by metes and bounds in the in struments of transfer or other document used in the process of selling or transferring shall not exempt the transaction from such penalties. Orem City may enjoin such transfer or agreement by action for iriunc-;ion iriunc-;ion or ma" : r he said penalty by civil action. Section 11. Definitions. In this ordinance, whenever appropriate, the singular includes in-cludes the plural and the plural plur-al the singular. The term "street" includes streets, highways, high-ways, avenues, boulevards, parkways, roads, lanes, walks, alleys, viaducts, subways, tunnels, tun-nels, bridges, public easements, and rights-of-way and other ways. The term "subdivision" means the division of a tract or parcel of land into two or more parts for the purpose, whether immediate or future, of sale for residential or building development. develop-ment. - Section 12. Construction of Ordinance. If any section, subsection, sentence, clause, or phrase of this act is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion por-tion of this ordinance. Section 13. Violation Penalty. Pen-alty. Violation of any of the provisions pro-visions of this act shall upon conviction be punishable at a misdemeanor. Orem City, or any owner of real estate within with-in the district in which such, building, structure or land is situated, may, in addition to other remedies provided by law, institute injunctions, mandamus, man-damus, abatement or any other appropriate action or actions, proceedings or proceedings to prevent, enjoin, abate or remove re-move such unlawful erection, construction, maintenance or use. Section 14. It being deemed by the City Council of Orem City, that an emergency exists and that it is in the interest of the peace, health, safety and welfare of Orem City, and the inhabitants of Orem City, that this ordinance ordin-ance . shall take effect immed iately upon its passage and pub lication; such emergency exists by reason of the rapid growth of Orem City; and the large influx of people Into Orem City; that there is a large increase in-crease of homes and businesses; that applications for building permits have greatly increased; that -there Is a considerable number of application for building permits now to be passed upon; that it is pruoable that there will be a large Increase In-crease of building of .homes and businesses and that Industrial plants will be erected, and In order to have such , buildings and improvements erected under und-er an orderly and general plan and in order to meet the Immediate Imme-diate need It is necessary for the immediate passage of this ordinance. - -NOW THEREFORE, it ; Is hereby ordained that this ordi-, nance shall take effect immediately immedi-ately upon its passage and publication. pub-lication.
