Queremos hacerle saber que el Servicio de Inmigracion y Naturalization (INS) sieue trabaian- do para esclarecer como se Uevara a cabo el proceso de aplicacion bajo el Acta ae uie. una ae las provisiones temporales del Acta de Life, es la extension temporal de la Seccion 245(1) de las leyes migratorias. La Seccion 245(1) no es amnestia para todas las personas que se encuentran en Los Estados Unidos ilegalmente. Esta solo se aplica a ciertas personas que residen en los EEUU, que tunque son eicgmics para una visa de inmigrante, estan prohibidos para ijustar su estatus. con esta ley pueden liacerlo sin dejar el pais . Para poder guardar este priviligio de ajustar su estatus migratorio bajo il Seccion 245. la persona debe ser el berveficiario de una petition de Visa de Inmigrante (Formulario 1-130 o I- 4tJ). o una aplicacion certiticada por 1 Departamento de Trabaio someti- da antes del 30 de Abril. 2001. Si usted aplico despues del 14 de Enero de 1 W8. usted debe demostrar que estaoa tisicamente en los tstaaos Unidos. desde el 21 de Diciembre del 2000. Una aplicacion para ajuste de status (Formulario 1-485 ) bajo la eccion 245(1) no necesita ser sometida antes del 30 de Abril de 2001. La aplicacion se somete cuan- do una visa de inmigrante sea aprovada y un numero de visa es disponible. El aplicante debe pagar una multa de $1000 para procesar su aso dentro de los hstados Unidos. ademas de pagar el costo de la aplicacion. We want to let you know that the Immigration and Naturalization Service (INS) continue con-tinue working to clarify how the application process of the Act of Life will take place. One of the temporal tem-poral provisions of this Act is an extension on time, of Section 245(1) of the immigration laws. Section 245 is not an amnesty for all persons who live in the United States, and even though they are eligible for an immigrant visa, they are prohibited to adjust their status. With this law they can do it without leaving the country. In order to keep this privilege of adjusting the migratory status under Section 245(1), the person has to be the beneficiary of an immigrant visa (Application 1-130 or 1-140), or have a certification from the Work Department, submitted before April 30, 2001. If you applied after Jan. 14, 1998. you have to prove that you were here, in the United States, since Dec. 21 of 2000. An application for status adjustment adjust-ment (Application 1-485) under Section 245(1) doesn't need to be submitted before April 30, 2001. This application has to be submitted when an immigrant visa is approved and a visa number is available. The applicant has to pay $1,000 to process their case in the United States, besides the cost of the form. Family members that you can ask for 1) Spouse and children under 21 years of age (singles) of citizens. 2) Parents of citizens, if the citizen citi-zen is older than 21 years old. 3) Children of citizens that are older than 21 years of age and singles. sin-gles. 4) Spouses and children under 21 years of age (singles) of permanent residents. 5) Children older than 21 years old (singles) of permanent residents. resi-dents. 6) Married children of citizens. 7) Brothers and sisters of citizens. The children of divorced parents count as singles. Half brothers or sisters count as brother and sister. The children of unmarried couples and their parents, adopted children and their parents, stepfathers and stepmothers and stepchildren also can qualify to apply under this law. I recommend you contact a lawyer who specializes in immigration. immigra-tion. This law is very new, and many attorneys don't know about it especially if isn't their field. Look in the phone book for immigration lawyers.
