Show "The Park Record D Section A Thursday, March 9, 1995 B Page A5 Former legislators are exonerated In allegations of budget misappropriation Wash Up And Come Into by NAN CHALAT-NOAKER Record staf writer :; According to former House speaker Glen Brown, he was -unfairly drawn into a controversy , he had deliberately tried to avert ""Brown was named in several Salt 'Lake Tribune articles regarding a 'possible misappropriation of state "funds for a private nonprofit c 'program aimed at helping 'rehabilitate inmates after release from prison. : Brown, a Republican who lives - in Hoytsville and operates a dairy : farm, is a Summit County Planning Commissioner. ; " The controversy came to light ; "when the Utah Attorney General's ): office was asked to look into - 'charges that certain legislators had : "circumvented state procurement policies by naming a specific : program, Exodus, in HB 360, the ?- Appropriations Act. According to I intent language accompanying the 7 bill, Exodus was targeted to receive a' $90,000 state grant By law, that allocation must be advertised and "'put out to bid " " Brown, because of his involvement as a volunteer prison chaplain, said he had been drawn into the picture when asked to help draft language for the bill which -.. would enable Exodus to qualify for the funding. But, Brown claims the language he wrote and faxed to the legislature did not mention Exodus. "I knew it should not say Exodus in the law. I got involved to help clean up the language, but after that something changed." Brown admits he knew there was some controversy surrounding the program, that a former legislator and a fiscal analyst both wanted the state to help fund the program but apparently, he said, someone in the Corrections Department did not want the money to go there. Former Senate President Haven Barlow and fiscal analyst Bill Dinehart had been accused of previously trying to coerce funding for the program. Brown, however was not named in that investigation. According to Brown, the intent language he wrote was meant to insure the money went for services not for assessment. Previously, Brown said the Department of Corrections "put a spin on it" and used money aimed at reducing recidivism for assessment" Brown said his understanding was that Exodus would use the money for direct prisoner re-entry expenses like gas, food, lodging and job placement Brown, whose brother Mel is currently Speaker of the House, said he was particularly offended by the insinuation that he may have used his influence to circumvent state policy of putting all state funding out for bid. "This (his efforts to write the language) was to correct the thing, to make sure there would be no criticism." Brown went on to say, "It's not as gory and gruesome as people like to read into things. ..It's a classic example of why there are bad feelings between the media and legislators... They (the media) ought to get their facts straight." According to Brown, the Tribune article was premature and he was particularly disappointed in the headlines suggesting that he was under investigation. "I have never been under investigation. I have no reason to be. The inference is very damaging." According to the most recent reports in the Tribune, and the Deseret News, the Attorney General's Office and the members of the legislative leadership are now satisfied there was no wrong doing. Brown speculates that when the proposed appropriation was moved from the Department of Corrections to the Office of Education, an analyst there inadvertently reintroduced the word Exodus, not knowing it was a violation of the procurement act. In any case, Brown said, state law would have prevailed and the grant would have been put out for bid. Nine people sentenced in Park City court Judge Roger A. Livingston sentenced nine people in Park City's Third Circuit Court Feb. 28. Steven C. Grant of Park City, 3ate of birth Jan. 27, 1965, pleaded .guilty to an amended charge of disorderly conduct, a Class C misdemeanor. He was fined $270, of which $150 was suspended. -'-Kelly Ray Marcellin of Park - City, date of birth Dec. 11, 1960, .pleaded guilty to public .intoxication, a Class C misdemeanor. Marcellin was fined $200, -of which $150 was "suspended. Marcellin also pleaded "guilty to possession of drug paraphernalia and was fined $500, of w hich $400 was suspended. n I.- Marc D. Romney of Salt Lake City, date of birth Feb. 12; 1975, pleaded guilty to an amended charge -of reckless driving, a Class C misdemeanor. He was fined $500, of which $400 was suspended. He was also ordered to perform eight hours of community service. t.' Gregory James Beall of Park . City, date of birth Dec. 15, 1970, pleaded guilty to driving under the influence of alcohol, a Class B Court News misdemeanor. He was fined $1,250, of which $750 was suspended. He was also sentenced to 120 days in jail, of which 110 days were suspended. Beall was also ordered to perform 72 hours of community service. Salvador B. Allen of Park City, date of birth April 15, 1967, pleaded guilty to driving under the influence of alcohol. He was fined $650 and ordered to perform 24 hours of community service. He was also required to complete an alcohol education program. Geraldine E. Briggs of Park City, date of birth March 30, 1955, pleaded guilty to speeding, a Class C misdemeanor, and was fined $52. Christopher Tyler Medley of Salt Lake City, date of birth May 8, 1974, pleaded guilty to driving under the influence of alcohol. He was fined $650, of which $250 was suspended. Rob Olisa of Park City, date of birth unavailable, pleaded guilty to an amended charge of disorderly conduct He was fined $250, of which $150 was suspended. Bruce R. Kutz of Easton, Penn., date of birth Feb. 10, 1969, pleaded guilty to theft, a Class A misdemeanor.
