A vacant lot shall not include what would otherwise be defined herein as a vacant lot if a legally enforceable restrictive covenant, acceptable in form and content to SPWSSD, has been duly recorded against said lot, pursuant to which the owner shall covenant that: (i) such lot shall remain vacant and that no water connection will be required for said lot for the reason that such lot is used or to be used only in connection with another lot upon which the owner's home or structure is situated, and (ii) that such restrictive covenant shall not be removed from said lot without the prior, express written approval of SPWSSD. ESTIMATED COST OF IMPROVEMENTS IMPROVE-MENTS The total cost of improvements in the District is estimated to be $357,000, all of which shall be paid by i a special assessment to be levied against the property which may be directly or indirectly benefited by such improvements which benefits need not actually increase the fair market value of the property to be assessed. In lieu of utilizing the County's existing guaranty fund, SPWSSD intends to create a special reserve fund to secure payment of the special assessment bonds SPWSSD anticipates issuing after the completion of the proposed improvements. The reserve fund will be funded from proceeds of the special assessment bonds in an amount equal to approximately 10 of the total cost of the proposed improvements, or $32,500. The amount required to fund the reserve fund will be added to the total amount assessed against the properties benefiting from the improvements. The total cost of improvements, plus the amount necessary to fund the reserve fund, shall therefore be paid by a special assessment to be levied against the properties benefiting from the improvements as specified herein. The total estimated cost of the improvements may be financed temporaneouslyl by the use of interim warrants. The interest on said warrants will be assessed to the property owners. SPWSSD anticipates applying any moneys remaining in the Reserve Fund to the final payment on the special assessment bonds anticipated to be issued, which, in turn, would offset the final assessment payments to be made by the owners of property benefited by such improvements, all of which will be further described in the assessment assess-ment ordinance to be adopted by the Board. The estimated cost of improvements to be assessed by connection against the lots within the District is as fo"ows: Improvements: Water rights: The estimated cost of assessment includes estimated overhead costs which the Board projects to incur in the creation and administration of the District. ASSESSMENTS AND LEVY OF TAXES: It is the intention of the Board to levy assessments as provided by the laws of Utah on all parcels and lots of real property within the District benefiting by the proposed improvements described herein. The purpose of the assessment and levy is to pay those costs of the subject improvements which SPWSSD will not assume and pay. The method of assessment shall be by lot as set forth hereinabove. The assessments may be paid by property owners in ten (10) annual principal installments with interest on the unpaid balance at a rate or rates fixed by the Board, or the ' whole or any part of the assessment assess-ment may be paid without interest within fifteen (15) days after the ordinance levying the assessment becomes effective. The assessments shall be levied according to the benefits to be derived by each property within the District.
