The district's board of commissioners last week directed Barney Saunders, attorney for the district, to file for a declaratory judgment in the issue which has been going on for some three years. Jean Buchanan, fire district commissioner, explained ex-plained that when Summit Park development began some 20 years ago, few guidelines for planning and developing existed and hydrants were placed haphazardly throughout the subdivision. According to School Counselor Coun-selor Kent Larsen, the candidates can-didates were selected by an in-house faculty committee. He said each student will prepare a portfolio, to be presented to a panel of judges April 29. Park City High School is competing in the Northeast Utah Region which includes Rich, Morgan, Summit, Daggett, Duchesne, Uintah and Wasatch Counties. Larsen said the winner and two runners-up in each of the 12 categories in the contest will receive a cash prize and a tuition waiver to a Utah college or university. Its sole responsibility, the water company said was to provide culinary water. Hydrants remain in a state of disrepair in spite of attempts at-tempts by the county and the fire district to negotiate the matter of responsibility Buchanan said, but the privately-owned water company com-pany said it would not assume any responsibility without direction from the court. Many of the hydrants, Buchanan said, were placed on the downhill side of the roads and have been consistently con-sistently damaged by county snowplows. The county had agreed to pay for repairs to thneo hi'Hronfs cn damaged. the fire district agreed to make sure hydrants were in operating order, and homeowners association members agreed to aid in keeping tabs on broken hydrants. But the water company has maintained all along it is not responsible for water for fire protection, she said. Saunders said he is planning plan-ning to file in the next week a request with the court for a declaratory judgment and a writ of mandamus to order the Summit Park Water Company to begin maintaining main-taining fire hydrants in Summit Park. Joseph Novak of Salt Lake City, attorney for the water company, said he was not aware of the proposed action and could not comment on the issue.
