Uriarte has lived in Park City since 1927 and has worked for the school district for the past 26 years. Gold's Argument Presenting his appeal to the council for the second time, Gold reiterated his feeling that the commission had no legal basis for imposing the sprinkling system condition. Claiming that the commission com-mission acted arbitrarily, Gold told the Council, "This is supposed to be a system of laws and not benevolent dictators." Gold who serves as Park City's Justice of the Peace, also said the law does not ' provide the commission with "carte blanche power to impose conditions not outlined by the governing body." As for the city's problem of inadequate fire protection, the developer stated, "I didn't cause the problem so why should I be penalized for it?" . Planning Commissions ' Argument 67-IG-5 Burnis Watts, chairman of the planning commission, presented the council with a detailed statement explaining ex-plaining the rationale and authority which he felt supported sup-ported the commission's ruling. The statemen t cited a 1968 Park City ordiance per--,taining to conditional use permits. The ordinance, in part, reads: "67-16-5-Basis for issuance of Conditional Use Permit (2) That such use will not,-under the circumstance1 cir-cumstance1 of the particular case and the conditions imposed, be detrimental to the health, safety and general welfare of persons nor injurious in-jurious to, property or im-" provements,, in t,he cony,, "The Commission views each use permit on its own merit. The Commission felt that the uniqueness involved with this permit justified the action. The Commission did not intend to set precedence as has been suggested or arbitrarily place hardship on any requests. It is the policy of the Commission to invoke conditions when the, Commission Com-mission ascertains the need to clarify, meet special requirements or to facilitate r the intent of the or-dianances.": or-dianances.": City Attorney With regards to the city's legal position City Attorney Carl Nemelka told the A council, "I would not be able ' to defend the planning u commission's decision in court since I cannot find any evidence where you've required anyone else to do it. i If you want him to put in a ; sprinkling system you are going to have to change the ordinance." After hearing Nemelka's opinion, along with the other information, the council moved to approve plans for-the for-the apartment complex with . the stipulated conditions. The Real Problem ' ' After voting, each council member assured Watts that . their overruling of the commission's decision was in no way a reflection on the commission's authority to impose building conditions. They cited a need for more definite guidelines in' sucli matters. Concerning the fear some have expressed of "too much" growth this summer and "too little" in future years, Uriarte said, "I don't' see a boom and bust situation developing. I feel confident the economic picture will dictate and regulate the growth." When , asked if he ever would be in favor of limiting development, the mayor replied.'i am not in favor of imposing any type of growth ceiling. As long as people comply with the ordinance and receive the planning commission's approval why should we- discriminate against them?" Needed Services "As the town grows," Uriarte explained,"it will be able to provide services that , are presently not being offered." of-fered." "I would like to see the city investigate the possibility of reducing the impact fees for building on on Main Street in order to encourage its development. I consider the Main Street area to be one of Park City's major attractions." When asked about his feelings toward the proposed Main Street chairlift the mayor said, "I'm indifferent about the chairlift. I'm neither for it nor against it, It could cause some inconveniences in-conveniences for local people but it could also help alleviate some of the city's transportation tran-sportation problems." Mining Museum The mayor expressed an interest in the possibility of a ,1 Park City mining museum. "We're neglecting the mining part ot the com-j munity which is really the heart of the town's uniqueness, he explained. 1 One of the communities major assets according to Uriarte is the fact that the U S. Thursday night approved Mayor Leon Uriate's recommendation that City Recorder Bruce Decker be appointed as City Treasurer. The Mayor explained that since Decker already handles the city's' accounting department the only real change will be in his official title.
