Show V PROVO (UTAH) DAILY HERALD, V WEDNESDAY, APRIL 24, 1940 PAGE FIVE that the City of Provo City will not hereafter issue any bonds or obligations payable from the reve nues of the system until all bonds herein authorized have been paid in full, unless such additional bonds are issued in such mannei that they are in all respects subordinate sub-ordinate to the bonds herein auth orized Section 12.' That If at any tim after the bonds herein authorized 6r any part thereof, shall have been issued the Board of Commis v sioners shall find that said bonds can be called for payment and re funded at a lower rate of inter est and' 60' terms advantageous to the city, the Board of Commis sloners shall have authority ' tc authorize the issuance of refund Ing" bonds for the purpose of re funding said outstanding: bonds in whole but not in part. Said; re funding bonds shall be secured in all respects as are the bonds herein authorized and shall be issued is-sued with such details - as the Board of Commissioners may pro vide,' provided only that the ma turities of " the bonds are not lengthened and that the interest rate to be borne by the bonds is not Increased. After refunding bonds are so issued, the holder thereof shall be subrogated tc all of . the rights and privileges en joyed by the holders of the bonds refunded thereby. Such refunding bonds may either be sold by the Board of Commissioners in sucr manner and at such pcice not less ' than par and accrued interest as may be determined by the Board of Commissioners or if the hold ers of the bonds to be refunded are willing to surrender such bonds the refunding bonds may be delivered to such holders lr exchange , for a like - principa amount or amounts of outstanding bonds. Section 13. That the bonds here in authorized , to the amount ol t . 5850,000, which bonds may be any of the total authorized, issue ol - $1,200,000 without distinction af to number or maturity, shall be delivered to the purchaser thereof and paid 'for, and the proceeds used, solely, for the payment and cancellation of a like principal . amount of the bonds authorizec to be : refunded. Such refunding bonds may. be delivered In blocks from time to time. The remaining ' three . hundrec fifty bonds of the total issue o. $1,200,000 herein authorized shall hs delivered toHhe purchaser and ' paid for at one time or in blocks from time to time as the proceeds thereof are needed for the completion com-pletion of the system. Section 14. That the 'action of the Board ; of Commlssiohers in calling an election for the purpose of submitting to the qualified tax-paying tax-paying voters of Provo City the question of the Issuance of the . bonds herein authorized is hereby approved, ratified and confirmed, -.ten a Section 15w That the provisions of this ordinance shall constitute; a contract between the. City of ' Provo City' and the holder or holders hold-ers of the bonds herein 'authorized to be issued, and that after the Issuance of any of such bonds no change, variation or alteration o. any kind In the provisions' of ; this ordinance shall be made in any . manner except as herein, provided . . until such time as all of said bondq x. issued hereunder and interest due thereon have been paid in full.; Section 16. That if any section. paragraph, clause or provisions of - this ordinance shall be held to be invalid or unenforceable for an reason, the invalidity or unen- forceability of such section, paragraph, para-graph, clause or provision shall , not affect any of the remaining provisions of this ordinance. ' Section 17. That all ordinances resolutions and orders, or parts thereof in: conflict with . the . provisions pro-visions of this ordinance are, tc the extent' of such conflict, hereby repealed. That " the City Re corder is instructed and directed to prepare the publicity pam phlet required by Sections 18 and 23 of Chapter 10, Title 25, Utah Revised Statutes, . 1933, to Incor porate therein the arguments for and against the measure filed with him, in accordance with the provisions of said Section 23. and to distribute said pamphlets to every voter of the City of Provo City, either ty mail or carrier. to the date herein fixed for the election, at which said proposi tion is to be voted upon.
