' Bullock reported he was still of the opinion) that Lewiston officials would confer with the Provo committee before making a decision de-cision as to where to transfer its franchise. Halliwell is reported to have said that directors would be asked to ratify- Lewiston's action in transfering their franchise to Idaho Falls, after which the 1940 schedule would be worked out. Several cities are expected to ask league officials to enlarge the circuit to eight'' teams. Included in this group are Logan and Nampa. The property owners, who charge that the By-Products corporation's cor-poration's plant is a nuisance' by reason' of offensive odors, seek damages totaling $56,000. ' Judge Hoyt, who is ' sitting as judge protem in the case, denied an injunction to prevent operation of the plant some months ago. ' He held at that time that the plant constituted a nuisance,' but that the property owners were not entitled en-titled to an Injunction since they did not start the suit until ( after the company had partially rebuilt its plant. He ruled at that time, however, that the plaintiff's might sue for damages.
