NOTICE OF DISPOSAL OF SPECIAL EDUCATION RECORDS The confidential special education records of students stu-dents graduating from high school or discontinuing discontin-uing their special education participation before 1993 are scheduled sched-uled for destruction by Uintah School District. In accordance with federal statutes, these records are kept for a minimum of five years after completion comple-tion of the student's special spe-cial education program. Unless otherwise requested request-ed by parents, guardians, or former students of legal le-gal age, special education records prior to 1993 will be destroyed after August 1, 1998. Several reasons exist for destroying these records. Most obvious is the storage problem that would be created by keeping such bulky records indefinitely, another an-other reason is the need to maintain confidentiality confidentiali-ty when continued existence exis-tence of the outdated records serves little or no logical purpose. ORDINANCE NO. 6-4-91 DATE 6-16-98 AN ORDINANCE ENACTING EN-ACTING CHAPTER 3.06 UINTAH COUN-TY COUN-TY CODE OF ORDINANCES, ORDI-NANCES, 1986, AS AMENDED, RELAT-ING RELAT-ING TO THE IMPOSITION IMPOSI-TION AND COLLECTION COLLEC-TION OF A TOURISM, RECREATION, CULTURAL CUL-TURAL AND CONVENTION CON-VENTION TAX The Board of County Commissioners of the County of Uintah ordains as follows: SECTION I. That effective effec-tive July 1, 1998, Chapter 3.06, Uintah County Code of Ordinances, 1 986, as amended, is hereby here-by enacted as follows: Chapter 3.06 TOURISM, RECREATION AND CONVENTION TAX Sections: 3.06.010 Provisions ' 3.06.020 Statutory Authority 3.06.030 Purpose of Provisions 3.06.040 Definitions 3.06.050 Imposition -Amount 3.06.051 Use of Revenues 3.06.060 Collection 3.06.070 Licensure 3.06.010 Provisions. The ordinance codified in this chapter shall be known as the Tourism, Recreation, Cultural and Convention Tax of the County of Uintah. 3.06.020 Statutory Authority. The authority for imposing im-posing this tax is derived from Title 59, Chapter 1 2, Section 601 et seq. Utah code Annotated 1 953. 3.06.030 Purpose of Provisions. The ordinance codified in this chapter is enacted to provide the County with a source of revenue specifically for the purpose pur-pose of financing in whole or in part the development, de-velopment, operation and maintenance of tourist, recreation, cultural and convention facilities and the Board of County Commissioners hereby directs that the provisions hereof be interpreted and construed to accomplish the stated purpose. 3.06.040 Definitions. As used in this ordinance: ordi-nance: (1) "Convention facility" means any publicly pub-licly owned or operated convention center, sports arena, or other facility at which conventions, conferences, con-ferences, and other gatherings gath-erings are held and which primary business or function func-tion is to host such conventions, con-ventions, conferences, and other gatherings. (2) "Recreation facility" fa-cility" or 'ltourist facility" facili-ty" means any publicly owned or operated park, campground, marina, dock, golf course, water park, historic park, museum, muse-um, theater, monument, planetarium, bicycle trails, and other recreation recre-ation or tourism related facility. (3) "Cultural facility" facili-ty" means any publicly owned or operated museum, muse-um, theater, art center, music hall or other cultural cultur-al or arts facility. (4) (a) "Restaurant "Restau-rant means any facility where food is prepared for immediate consumption, consump-tion, including but not limited to coffee shops, restaurants, luncheonettes, lun-cheonettes, soda fountains, foun-tains, fast food services or outlets, and all other similar facilities. (b) "Restaurant" does not include any retail re-tail establishment whose primary business or function func-tion is the sale of fuel or food items for off-premises, off-premises, but not immediate, imme-diate, consumption. (5) "Short-term lease or rental of motor vehicles" means any lease or rental of a motor vehicle not exceeding thirty (30) days in length. There is hereby levied for collection tourism recreation, cultural and convention taxes on the following activities at the rates set forth below: (1) A tax is hereby imposed at the rate of 3 of the lease or rental amount on all short-term leases and rentals of motor mo-tor vehicles as defined herein which are made within Uintah County. The short-term motor vehicle ve-hicle rental shall be deemed to have occurred within Uintah County, if the rental is or would be subject to a local option sales and use tax ordinance ordi-nance of Uintah County or any city or town in Uintah County. 3.06.051 Use of Revenues. The revenues received from the tourism, recreation, recre-ation, cultural and convention con-vention taxes levied pursuant pur-suant to 3.06.050 (1) and (2) shall be used solely for the purposes of financing, fi-nancing, in whole or part, tourism promotion, and the development, operation, opera-tion, and maintenance of tourist, recreation, cultural, cultur-al, convention facilities as defined herein. 3.06.060 Collection. Taxes imposed under this chapter shall be levied at the same time and collected in the same manner as provided for in Title 59, Chapter 12, Section Sec-tion 201 et seq. (1 953, as amended) except that the revenue derived from the tax is not subject to the collection and distribution distribu-tion procedures established estab-lished pursuant to the provisions of Subsection 59-1 2-205(2), Utah Code Ann. 1 953, as amended. 3.06.070 Licensure. All persons, companies, corporations or other similar sim-ilar persons, groups, or organizations engaged in the business of short-teim rental or motor vehicles or doing business as restaurants shall obtain, from the State Tax Commission, Com-mission, a tourism, recreation, recre-ation, cultural or convenient conve-nient tax license. No such additional license shall be required if the person, company, corporation, corpo-ration, group or organization organiza-tion has obtained a license li-cense pursuant to Section 59-12-106 Utah Code Ann.
