Show THE LETTER OF INTENT i Interpretation of the Constitution of the United States that document which all at once is described as the most democratic of all vehicles, the most perfect, the simplest, sim-plest, the most honest, and the most indiscriminate, always al-ways falls back to an interpretation of the intent of the writers. Simply because the English language is not suf-ficently suf-ficently precise enough to know what a man really means unless you know with what intent words were written. Intent is defined to mean the thought, feelings, practice, prac-tice, disposition, and in fact, intentions of those involved. In other words, in interpreting the Constitution, the Supreme Su-preme Court must take into consideration not only the wording, but the intentions, feelings, convictions and practices prac-tices of the writers and perpetrators of this document. I With this vein of thought in mind we fail to see or understand, the recent ruling of the Supreme Court on the death penalty. They based their majority opinion on ' the fact that the death penalty violates the constitution in that it is cruel and inhuman. They based this judgment not on the fact that those writers of the Constitution felt that death was a cruel and inhuman punishment, but rather, ra-ther, on the fact that they themselves, or at least five of the Supreme Court members, felt that death constitutes a cruel and inhuman punishment. But, they failed to consider that those gentlemen who j wrote the constitution, themselves did practice the death penalty, many of them did indeed preach an eye for an eye, and did in fact believe in the death penalty, if we are to believe the history books. Next this highest of all courts in the land will, decide that it is cruel and inhuman to incarcerate a convicted con-victed criminal, a murderer, behind bars, solitary confinement confine-ment and maximum security cells will be the first to go. Let us hope that before these distinguished gentlemen gentle-men again let their emotions interfere with their duty, they learn that it is thei rduty to discover the intent of that document which has permitted free men to create the greatest country in the world. It is their duty to interpret and let our elected representatives legislate. We commend Attorney General Romney for requesting request-ing they permit the death penalty to stand in Utah. Red |
