Show the license fee for the license , ich should have been pre ctred, or the license fee for hUe license which has been issued, is-sued, as the case may be, sha be due and payable and shall be deemed delinquent and may be collected in either or both of the following ways: (a) By a legal action brought in the name of Beaver County against the person obligated for such license fee; or, (b) By seizure and sale by the Beaver County Sheriff of the television set or sets, respecting re-specting which the license is required, in the same manner as is provided by law for the seizure and sale of personal property by the county treasurer treas-urer for the collection of taxes on personal property; provided provid-ed however, that, in addition to 'the notice which is now or may hereafter be required in the case of sales of personal property for the collection of deliquent taxes, a notice, containing con-taining the date, place and purpose of the proposed sale and the amount of license fee which is claimed to be a delinquent, delin-quent, shall be mailed to the person obligated for such license li-cense fee, if known, to his last known address, at least ten days prior to the date set for the sale. If the delinquent license li-cense fee and all accrued costs shall be paid prior to the date set for the sale, the television set or sets so seized - shall be released to the person entitled to the possession thereof. Any surplus money realized from such sale, over and above the delinquent license fee and all actual and reasonable costs of seizing, keeping . and . selling said television set or sets, shall ' be returned to the owner of said television set or sets, if known, but if not known, shall be retained by the officer conducting con-ducting the sale for a period of six months after such sale and, if not claimed prior to the expiration ex-piration of such six months period, shall be paid into the Beaver County Treasury as the property of the county. The area of Beaver County, Utah, llying outside the corporate Zloi cities and towns, hereinafter here-inafter referred to as such area," is hereby declared to be an area so remote from regular reg-ular transmission points, of the large television stations that television reception is impossible impos-sible without special equipment and adequate, economical ana proper television is not available avail-able to the public by private sources. SECTION 2: LICENSE REQUIRED. RE-QUIRED. From and after the 1st day of July, 1961, no owner own-er of any television set or sets shall keep such set or sets within such area without having hav-ing a license so to do as hereinafter here-inafter provided. Such license li-cense shall be procured from the County Clerk of Beaver County, and it shall be the duty of the said clerk to issue such license upon application being duly made therefor and upon payment of the required license fee. Every such license li-cense shall state the name of the licensee, the number of television sets covered by the license and the period of time for which the license is issued. Each license shall be issued for a period of one calendar year, that is, from the 1st day of January to the 31st day of December, inclusive, except that, if the license is not applied ap-plied for prior to the 1st day of July of the year, it may be issued for the last six months of that year; provided, how-i ever, that ali licenses issued , for the year 1961 shall be for the last six months of the year, there being no licensing requirement prior to July 1, 1961. Possession, whether actual ac-tual or constructive, andor use of a television set by a person, firm or corporation, shall be presumptive evidence of ownership own-ership thereof. SECTION 3: LICENSE FEE. Each applicant for a license shall, at the time of applying for such license, pay to said county clerk as a license fee for a full year's license, the sum of twelve dollars for one television set and the sum of one dollar for each additional television set owned by him; or, as a license fee for a license li-cense for the last six months of a year, one-half of the fee for a full year's license. SECTION 4: GRACE PERIOD, PER-IOD, COLLECTION OF FEE. Jhere shall be a grace period of one month from and after the date when an original or renewal license is required within which to procure such license.
