Reservist Widows and Orphans May Get Thousands in 'Back Pay' On the basis of a decision rendered by the Employees Compensation Appeals Board of the U S Department of Labor, widows and orphans of thousands thous-ands of reservists were found to have sums running from several sev-eral hundred to several thousand thous-and dollars due them in back benefits under the Federal Employes' Em-ployes' Compensation Act. The decision was issued by 1he Appeals Board after considering con-sidering two test cases presented present-ed by The American Legion s National Economic Commission staff member Austin Kerby. Previously, the Bureau o'f Employees Em-ployees Compensation had ruled that since the Armed Forces continue military pay for six months after an in - service death, compensation could not begin until then. This practice was being followed for cases affecting deaths of reservists in active duty between Sept. 8, 1945, and Jan. 1, 1957. The American Legion 1 contends con-tends that the six months military mili-tary pay was a gratuity having no bearing on the compensation act benefits. The Legion appealed ap-pealed two cases dealing with a widow with two children and one of a widow without children. chil-dren. The Appeals Board upheld up-held the Legion's position. Since the decision is stili open to appeal by the agency, actual "payments of back benefits bene-fits to widows will be delayed pending its decision to appeal, then will await the setting up of necessary machinery for payment. pay-ment. Reservists were not covered cov-ered by these benefits before Sept. 8, 1945, nor for deaths in service occurring after Jan. 1,1957. However, the number involyed is substantial since these benefits were available during the Korean conflict. |
