Show C ITI MONTE the city council met last saturday and transacted the following business relative to the dixie power co and its attitude toward the city resolution whereas the dixie power company grantee of albert L woodhouse who on oct 1816 1916 was granted a franchise to furnish electricity tor for all purposes tor for which it may be adapted to the city of st george and whereas on january 27 1922 the grantee 0 of albert L woodhouse the dixie power company issued the following order and notice to the st georger municipal corporation jan 27 1923 st george municipal corporation st george utah gentlemen you are as familiar as we are tire in the matter of our application to the public utilities commission for an adjustment of rate on our system and their findings as it pertains to the street lighting of st george city as well as the court house and library building in the absence of direct orders from the commission to continue this service pending a farthur hearing on the subject or through the city 6 request tor for service as provided in the findings of the commission we will have no alternative but to disconnect the street lamps as of february let 1922 as well as the court house and library building tou lou understand that under the commission commissions s order any service turn furn dished after february 1st 1922 must be paid for at the schedule rates as provided for such service as Is rendered yours truly dixie power co by A L woodhouse president whereas the above is in conflict with sec see 6 sub A sees 9 and 11 of 0 said franchise therefore be it resolved by the city council of st george city utah that the dixie power company be and they are hereby notified that said ac tion in said order is in direct conflict with section 6 sub A sees 9 and 11 of the franchise passer passed by the city council of st george city utah ou oil the day of october 1916 and you are hereby noti notified fled that st george city will not pay tor for the use of fifteen 15 kilowatts kilo wats or twenty 20 horsepower of electrical energy for the operation of its street lighting 0 or r other strictly municipal service as provided tor for in sec see 9 or any part thereof and will hold your raise in rates as being in conflict with A ith sec see 6 subdivision A sec see 11 of your fran ran chise and your failure to comply with the sections before referred to m vill III be considered by the city as a nullification and voidance vol dance on your part of the franchise under which you are now operating in the city of st george and be it further resolved that the city recorder be and he is here by ordered to deliver cliver df in person a copy of this resolution to the dent of the dixie power company or his agent passed by the city council january 28 1922 E miles seal city Ite recorder corder I 1 hereby acknowledge service of ro copy py of the above resolution this day of january 1922 flixie power co cc by A L woodhouse Wood houss president |
