Show constitutional AMENDMENT NO a 9 proposing to amend sections 2 and 8 3 article XIII of the Cont titu of utah R lating to property subject to taxation and rates of tax A proposing amendment to sections 2 and 8 article 13 of 0 the constitution of the state of 0 utah re lating to property subject to taxation and rates of tax be it resolved by the legislature of 0 the state of 0 utah two thirds third 8 of all the members elected to each house concurring therein section I 1 that it in 1 proposed to amend sections Sect lohs 2 and 8 of article 13 of the constitution ot of the state of utah so that such sections will read as follows sec see 2 to the end that the burden of taxation may be equitable upon all property the legislature Is empowered to divide all property including mon eye s and credits as well ta as physical property into classes and to deter mine what clas class or classes of 0 proper ty shall be subject to taxation and abat property it any shall not be subject to taxation tax taxes shall be uniform upon all property ot of the same class and shall ba be levied and collect ed tor for p public alic purposes only taxes may be imposed upon any and all property including privileges ran fran chides and licenses to do business in the state but this shall not be so con trued as to authorize the taxation of 0 the stocks of any company or corpora tion when the property of 0 such corn com pany or corporation represented by such stocks has been taxed the legislature is Is empowered to impose tax e et upon incomes which taxes may be graduated and prof creash e and reason mobil able we exemptions may be provided and a credit may be allowed on income taxes tales tor for property taxes paid within the year provided that nothing in this section shall permit classification ol 01 mines or mining claims see 8 the property ot the unit ed states ot of the state counties count lee cities towns school districts municipal corpora tlona ons and public libraries lot lots with the buildings thereon used ex clu elusively tor for higher religious worship or charitable purposes ees and places ot burial not held hold or used tor for private or corporate benefit and mortgages upon both real and personal property shall be exempt from taxation ditches canals reservoir reservoirs pipes and flume flumes owned and used by individuals or cor coil po rations lons lor for irrigating lande lauds owned by such ouch individual individuals or corporations or the individual member thereof ther eoff shall not be separately taxed taked eo go lorit as an they shall be owned and used ex elusively clu for euch such purpose a deduc tion of debits from credit credits may be b authorized and taxes ot of the indig indigent elit poor may be remitted or abated at such time and in such manner as may be provided by law see 2 the secre secretary tarr ot of state ti is directed to cause this proposed amend ment to be published as required by the constitution and to be submitted to the elector electors ot of the state at the next general election la the manner pro vided by law y see 8 it if approved by the elector electors ot of the state thia this proposed amendment shall take effect on the first day ot of january a nuary 1823 1923 approved march 17 1021 1921 |
