0 claims as an provided in S section 5 of theriel mining law P L enacted uly auly 23 1055 because of the numerous questions regarding the re quIre ments of the new law and how it affects mining claimants the following information may kl be of 0 help to persons persona holding pd mining claims the tha new law provides for an examination and search to obtain the names and addresses 0 of persons who are in actual possession or occupancy or who are working the lands this search is not an examination to determine the mineral character of the land the new law provides that when the search la is completed a notice will be published in a local newspaper for nine weeks describing the area searched and advising claim holders teat they have a day period from tw the date of first publication tp file a statement 2 of their intention intent IOP to assert thelt rights to the surface resources on claims located prior to the enactment of P L july 23 1055 1955 where ground search or search of tract indices in the county recorders office dis closes names and addresses of persons in possession or occupancy cu or working the lands they will receive a personal I 1 notice from the U S forest service any claimant not wishing or unable to watch for a publication in a newspaper can obtain a personal notice by filing with the county recorders office a request to receive a personal notice forms for this thia purpose may be obtained from the bureau of land management I 1 the response a mining claimant makes to this published notice will vary depending on his individual wishes and purl purposes uses normally he has one of the three following options 1 the claimant can ignore the notice it if he does this his claim automatically comes under the nev new law and the government assumes control of vegetative and surface resources and may construct roads across the claim however the government can not make any use of the surface which interferes with mate mining if the government sells timber from the ibe claim and it later develops that the claimant needs tim her ber to replace that which lias bas been sold the government must provid O free un amount equivalent to that sold the claimant receives full title to all surface yand subsurface resources when he be obtains patent 2 lie ile may execute a waiver whereby he all surface rights on or his hl which are contrary to the surface rights that th government would woul ave under the he art act for cladma located after july 2 23 3 1045 1 s 1 t 3 if the claimant wishes to retain the surface rights he had prior to the passage of P PL L he be may file a verified statement that sets nets forth a 0 abe date of location of his claim N b bool and page where notice or certificate or location is recorded 0 O c the location ol of his claim d whether he is ia the locator or purchaser under such location 0 e ills name and address and names and addresses of other persons claiming an interest to the claim if he files this statement government mining engineers will make a detailed mineral examination of his claim it I 1 this e examination discloses that the claimant has mado made q a mineral discovery no hearing will be required however ot 0 min aln eral discovery is considered to be lacking then the claimant will be notified that a hearing will be necessary to determine his right to control the surface resources this hearing will be held and the decision ren dered under the direction of a department of interior hearings examiner if the hearing bearing examiner renders a decision favorable to the claimant he retains me surface rights which existed prior to uie he passage of P L if the de e casion is against the clai claimant maAt his claim comes under the law and the government will as sume control of vegetative and surface resources gunder under this control the surface will be used for purposes df d man aging and administering the land only to an extent not in ter fering with legitimate min ing operations this puts the claim in the same category as those claims for which the owners have ignored the put published or personal notice A decision rendered against the claimant
