Show SHEEP DIPPING LAW UPHELD BY COURT 14 state commission brought ac uon tion against colorado WAS A TEST CAS CASE H IV H goslin blought sheep prom colorado refused to dip them in a decision handed down by judge A H christensen at price last week the state law which gives the board of adeep commissioners full au an to require owners of sheep to dip their sheep particularly ticul arly when they are being driven into utah fron frair come other state was upheld at af every point the case in which the decision was given is said to be the first brought to test thoroughly this law and members of the board of sheep commissioners ners are elated over the result W T goslin goslen of colliado Coloia ado do drove 22 head of sheep over the line into utah last fall the board of sheep commissioners had issued an order in august to compel the dipping of sheep driven over the state line from colorado goslin refused contending that his sheep had not been exposed since they were dipped t TP ouE ehring he asserted that tile the sheep could not be inspected and that the demand of the sheep was therefore unreasonable the board proceeded to take charge of goslins sheep with the result that goslin secured a temporary injunction preventing the blaid from acting he asked that the injunction be made permanent the court held that it would be presumed that the board considered it necessary essai essaiy y to issue the order to goslin to dip his sheep and that such an order would be considered a reasonable one the injunction therefore being dis solved judge christensen Christens cn ordered costs of the case assess od ed to goslin the law under which the order was passed and chiel goslin consid considered ercil unreason able is as follows section it 11 the board or any person in the emilo thereof snail have authority to enter upon premises where sheep are kept and to examine inspect and disinfect Ls ds infect sheep found thereon the board shall have authority to require owners of to apply such disinfectants disinfect ants dips and other curative agents as nay by the board or its employees plo be deemed necessary in order to prevent the introduction or of disease among the sheep of this state or to effect a cure of affected or infected sheep and in the event that any owner or custodian of sheep shall refuse or neglect to comply with the regulations of the board regarding the use of such disinfectants disinfect ants dips and curative substances within the time set by the board or its employees then th 3 board or its employees shall have authority t 0 cicat or disinfect any suh sheep and the cost thereof together with all incidental expenses therewith if any which shall in rude the cost and expense of the care and ol of the said sheep during tile the time of their custody by the board as herein provided shall be borne by the owner of the sheep so treated or disinfected dis infected and shall be until paid a first lien against such sheep cheep the case has been regarded with keen interest by many Hock masters of utah and states who have contended that the beard did not have tile the power to compel the he dipping of sheep unless ini action were discovered several cases have been taken up under the new sheep law but invariably those arrested for ifo violations lations pleaded guilty and paid pad fines rather than attempt to test the law |
