Show protection OF ORCHARDS rules and regulations promulgated by the utah state board of horticulture published in accordance with the requirements quire ments of legislative enactment to prevent the introduction into the state or spread of diseases and insect pests injurious to fruit and fruit trees alf and vines and providing for the extirpation of the same issued fot the guidance of horticulture inspectors spec tors nurserymen nurseryman nursery men shippers and owners of trees vines and fruits fruita in accordance with section 9 of an enactment of the seventh legislature assembly of the state of utah entitled an act creating a state board of horticulture providing for the publication and distribution of its reports for the appointment of county horticultural inspectors defining their duties the duties of nurserymen nurseryman nursery men and common carriers and to license nursery men making an appropriation for carrying out the provisions of this act and repealing chapter 98 laws of utah 1905 11 approved app raved march 14 1907 and in force on and after that date a meeting of the state board of horticulture was held in salt lake city april 1907 when the rules and regulations given below were adopted and promulgated for the protection and of orchards nurseries etc and are therefore binding upon all fruit growers fruit dealers nurserymen nurseryman nursery men and importers and shippers of tre es shrubs or vines and pon every owner possessor or occupant of any orchard or land where trees are grown within the state RULE I 1 it shall be the duty of ev ery owner possessor or occupant of any orchard nursery or land where any trees vines plants or shrubs are grow ng to a remove from said land and destroy by burning all diseased dead and decayed branches of trees and all rubbish and debris harboring insects disease or fungus growth b remove from said land and destroy by burning all fruit trees infected with peach yellows peach rosette or crown gall c spray all apple and pear trees of bearing age with an arsenical spray prescribed by the board of horticulture as aa soon as the blossoms fall and before the calyx cups close d to disinfect dia infect all trees vines shrubs plants and nursery stock found to be infested with injurious insects pests fungus or other disease dangerous to plant life by spraying or by applying other treatment prescribed by the board e all trees shrubs or vines found to be infested with the san jose or other scale insect shall be treated by spraying with kerosene emulsion double strength in summer cummer and lime sulphur mixture in the winter and before the foliage starts in the spring f to disinfect all trees found to be infested est with the disease known as pear blight or fire blight by cutting out and burning all affected branches and the whole tree if badly infected limbs i should be cut off a foot below the part affected the knife and saw used in cutting out the diseased limbs limba must be with kerosene or a five per cent solution of carbolic acid and in addition the stub on the tree should be dis infected with the same material to prevent the further spread of the disease the pear blight is a most pernicious and discouraging disease for which no remedy has thus far been discovered and the board suggests that it will be more economical to take out all badly affected trees both root and branch than to try to save them i by pruning RULE 2 it shall be the duty of county inspectors either in person or by deputy to a inspect all nurseries at least once during the summer in addition to the inspection after digging required bylaw by law and fee bee that they are kept free from injurious insect pests and fungus and other diseases dangerous to plant life b see that all nursery stock infested with pear blight peach yellows peach rosette or crown crown gall is destroyed by burning c quarantine qua antine all nursery stock found to be infested with any injurious insect pests peats fungus or other disease dangerous to plant life and hold them in quarantine until properly dis infected d examine all nursery stock brought into the country and see that it is free from all injurious insect pests fungus or other diseases dangerous to plant life e see that all shipments coming from points outside the i state elate are accompanied by a certificate of fumigation as required by section IT 17 of the horticultural law f see that all important nursery stock not properly certified is fumigated 9 eoe that shipments of utah grown stock are accompanied compa nied by a certificate of inspection h report immediately immedi atly to the secretary of the state board of horticulture the failure of any nurserymen nurseryman nursery men transportation company or common carrier or their amenta agents to comply with the provisions of the horticultural law or these rules rulea and regulations RULE 3 it shall be the duty of all persons firms or corporations engaged in the tha business of selling within the state or of importing any trees plants vines vinea or shrubs to a provide all salesmen or agents with a certificate of the state board of horticulture stating the name of such agents the name and address of the person or firm they represent together with the license number of such fi firm rm these certificates shall be good during the existence of the license and shall not be transferable b to attach a copy of the certificate of inspection to each shipment of trees for delivery in the state c e to file with the secretary of the state board of horticulture a statement of their annual business when making application for license d where printed copies of certificates shall file with the secretary of the state board of hort horticulture a duplicate not a copy of the original certificate RULE 4 the or destruction of all trees plants vines and shrubs shall be carried out on the order of any member of the state board of horticulture county inspector or deputy having jurisdiction and shall be carried out to the satisfaction of such officers RULE 6 5 no certificate shall be issued to any nurseryman until all stock is properly dis infected RULE 6 all formulas for spraying or infecting disinfecting dis any trees plants vines r L grubs shall be as prescribed by the state board of horticulture RULE 7 all shipments of nursery stock unaccompanied by a certificate as required shall be held in quarantine at owners risk until fumigated or bisin fectea as the case may be at the cost of the importer or grower any member of the state board bard of horticulture or county horticultural inspector may give a certificate stating that any nursery stock within his hia district or county i has been inspected and farni fumigated gated or when it shall be proved to the satisfaction of such euch officer that said stock has been so treated but no certificate shall be given by any officer stating that any nursery stock
