Show judge webbers gebbers Web bers court tuesday may 1 1906 instead of going out may walking justice henry webber spent the afternoon of may first in hearing two cases one for disturbing the pace and orie one fol foi keeping a disorderly house the two cases really diew out of a fight between two colorado prospectors in the vernal liquor house from the evidence vi dence presented the facts appear to be that marsh il richardson heard an uproar in the vernal liquor house on the afternoon of april 30 and rushed in to see what was the matter ile he found a man albert osborne stretched out on the floor bleeding profusely front from a wound over the right eye the marshal took the injured man into custody and placed him in tho the city bast bastile tle upon returning to wilhelmia Wilhel mya mys saloon the proprietors refused to divulge to the marchal what had happened ile he thereupon swore out a complaint against john and walter charging them with keeping a disorderly house another complaint was sloin to by the marshal alleging disturbance tur bance of the peace by john albert osborne and jim gilboy the two latter v ere the combatants as near as could be ascertained at the trial the firt case the one against the bo bos a was A as ground out and resulted in a dismissal of the case and the discharge of the defendants the other case the one for disturb j ing the peace resulted in the discharge of john and jim gilboy but albert osborne who appeared from the evidence to have been the aggressor was found guilty and fined 15 the city attorney was very much handicapped in this case as all the wit witnesses exe except ept the marshal were ve very unai unwilling il ang to give evidence the offence offense of the boys and the one which caused them to be dragged into court was their to impart information relative to tho the trouble in their saloon in fact they gave mr richardson to understand that they regarded him as a trespasser when he entered their place of business upon refusal to pay the fine of 16 15 imposed by judge webber albert osborne was placed in jail |
