Show NEW MINING G LAWS r an act providing for the manner of locating ema bud recording quartz and placer claims SECTION 1 A mining claim whether located by ono one or moro more persons may equal but shall not exceed one thousand five hundred feet in length along tho the vein or lode but no location of a mining claim shall be made until the discovery of the vein or lode within the limits of the claim located any lode mining claim may extend chico hundred feet on each side bide of the middle of the vein at tho the sur surface faco except whore where adverse rights render a lesser width i necessary the end lines ot of each claim must bo be parallel sec 2 tho the locator at tho the time ot of making the discovery of such vein or lode must erect a monument at the place of disc and must post thereon his hia notice of 0 location which notice shall contain 1st ast the name of the lode or claim 2nd and name of the locator or locators 3rd ard tho the date of the location ath it if a lode claim the number of linear f ft it claimed in length along the course of tho the vein each way from the point of discovery with the width on each side of the center of the vein and the general course of the vein or lode as near as may be and such a description of the claim located by ref orenco to some natural object or permanent monument as will identify the claim fth if a placer or mill site claim tho the number of or superficial foot claimed and such a description of the claim or mill site located by reference to some soine natural object or permanent monument as will identify the claim or mill site SEO sec 3 within thirty dagg from the late dato of discovery or establishment establish mout the locator must mark the boundaries of his lode or placer or mill site claim by establishing in each corner thereof and at any ango angle in the side a monument maikel with the name of the claim and ana the corner or angle it represents when from any cause a monument cannot be ba safely planted at the true corner or angle it must be placed us as near thereto aa as practicable and so marked as to indicate the place of buch corner or angle monuments maybe may be made ando of any such bach material and in such form as will readily give notice and ahon of posts or trees they must bo hown hewn and marked upon tho the sido side facing tohaid the discovery and must bo be tit least four inches in diameter monuments ments must be at least four feet high above tho the ground and steea atiee i must bo so GO howa hewn as to readily attract attention monuments and ana must be kept in such state of pio as to notify persons of the boundaries of the mining claim SEO 4 within thirty days from the date of 0 posting tho the location notice upon tho the claim the locator or locators or his hia or their ag assigns signs must file for record in the office collico of the county re cordei of the county in which such claim la is situated a substantial copy of buch notice of location such county recorder shall charge and collect a foe fee of one dollar for f filing and recording such sach notice provided that such notice of location shall not be abstracted unless a 0 subsequent conveyance affecting the same property bo be hied filed for record when said noaim shall be abstracted sk sio c 5 within ninety days from the date data of posting the location notice upon tho the claim tho locator or locators or his or mingus assigns shall do at least fifty dollars worth of work upon said claim E avery very person or company owning a group of claims and doing tho the development work dojk for said eaid group at one point shall post pent a notice upon vach each claim at the discovery monument stating where such work is being done SEC 6 tho the owner of any quartz I 1 odo lodo or placer mining claim who shall do or perform or cause to be done or performed the annual labor or improvements prove ments required require il by the laws of the united states in order to prevent a forfeiture of the claim must either during the year or within thirty days day after the completion of such each work or improve improvements monts it completed after the termination of said year in fit or for which said work was done or improve ments menta made tile in the office of the county recorder of the county in which such claim is situated art an affidavit or affidavits davita of the person or portions persona who performed such labor or made such euch improvements showing let lat the name of the claim and where situated 2nd and the number of days work done and the character and value of the improvements placed thereon 3rd ard the date or dates of performing said labor and making said oaid improvements prove ments and number of cubic feet of earth or rock removed ath at whose instance or request said work was done or improvements made ath the actual amount paid for said labor and improvements and by whom paid when the same was not done by the owner or owners of said claim such affidavits or duly certified copies thereof shall bo be prima facie evidence of the facts therein stated site SEC 7 it shall be the duty of each county recorder to record the mining rules and regulations of the several mining districts in his hia county without fee and certified copies of such record shall be received in nil all tribunals and before all officers of this state as aa prima flacie evidence of such ench rules and regulations SEC 8 the county recorders of the respective counties shall perform the baties heretofore performed by the district minin mining ra corders in such counties respectively and the district mining recorders of each county shall within thirty days after this act dball take effect deposit the books and records pertaining to their offices with the county recorder of the county in in which the district or the greater part thereof is situated provided that said books and records shall not be required to bo abstracted by the county recorder any district mining recorder who shall fail to deposit as aforesaid the books and records pertaining to his office shall be doomed guilty of a misdemeanor sze sac 9 copies of notices of location of mining claims mill sitoa sites and tunnel sites bites heretofore recorded in the records of the several mining districts tf and of the mining rules and regulations id ia force in the several mining districts in like manner recorded heretofore duly certified by the mining recorder shall be receivable in all tribunals and before all officers of this state as aa prima facie ev ideno SEC 10 where booke records and documents pertaining to the office of district mining recorder have been or shall hereafter bo be deposited in the office of any county recorder of this state such county ro recorder corder is authorized zed to make and certify copies and such certified copies shall bo be receivable in all tribunals and before all officers cerms of this state in the same manner and to the same as it if such records had bad boon been originally igi nally filed or made in the office of the county recorder SEC 11 the board of commissioners of each county shall provide ways and means for the transportation of nil all books and records pertaining to the OMCO office of the respective mining recorders to the offices of ita AS respective county recorders SEC 12 upon receipt of a petition signed by not loss leas than one hundred bona he fide minors miners residing in any mining district petitioning for tho the return of the records of such mining district the board of 0 county commissioners shall cause the records of such district to be copied by the county recorder with the joint assistance asa istance of the district recorder of such mining district it if the said district recorder wishes to render such assistance and ahall cabie the original records to bo be sent to such euch mining district recorder the copy so BO made chall remain in the office of the county recorder and shall be cons considered the original ri ginal record one half of tho the expenses of copying the said ree ads rda shall be paid out oat of the county treasury and one linof if shall be paid out of tho the st ate arc ury |
