precinct this certifies that at the request of I 1 have thia day appi alsed certain damage upon hero here dos promises premises upon which damage is done to hero describe nature of damage alleged logged al to have boon done by hero here describe tho animal alleged to hive done the darna damage 10 owned b by y hero give the name of the owner of the animals if known and if unknown state the fact on the here give date of the doing of tho the damage and after viewing the premises and making duo due examination and inquiry I 1 appraise tho tha same at the sum of and that my fees for making this appraisement are number of miles mileo traveled number of hours employed in making this appraisement pra iso ment dated ri gat this day of appraiser the appraiser shall deliver this certificate of appraise appraisement mont to tho the person damaged who shall also sign the samo and shall use due diligence to find the owner of said animals and for this purpose shall examine the territorial brand sheets in the possession of the constable and if the owner of said animal is known known and a resident of the precinct the person damaged shall within twenty four hours after the straining distraining di of said animals deliver to the owner thereof a copy of the certificate of appraisement of damage if the owner is known but not a resident of tho the pro pre whore where said eaid damage is done the person straining distraining di said caid animals shall within twenty four hours after said damage shall have been done deposit in the post postoffice office postage pro pre paid and registered a letter containing a copy of said certificate of appraisement addressed to the owner of said animals at his known place of residence see sec 2 soc sec 7 if at the expiration 0 of twenty four hours af after ter the straining distraining di of the animals mentioned in in the proceeding section the owner thereof cannot be found or if found shall neglect 0 or refuse to pay the damages 0 and costs thereon the party straining distraining di the same shall forthwith doliver deliver said animals with a copy of the corti certificate licate of appraisement to the constable of the th precinct wherein said damage is alleged to have been done and also deliver to the justice of tho peace of said precinct the cor of appraise appraisement mont soo 3 soc 8 upon receipt by tho the justice of tho tha peace of the certificate of appraisement he shall immediately file the samo same in his office and make the necessary entries in his docket as in other civil cibil cases and the said certificate of appraisement shall constitute the complaint in said paid case and the person straining di said ani animals shall be designated as the plaintiff in all subsequent proceedings in said case casa and the owner of said animals or if tho the owner ho be unknown then tho the unknown owner of tho animals briefly describing them shall be designated as the defendant and the justice of the peace shall immediately issue it a summons addressed address cd to tho the defendant requiring n i ng him to appear before said justice at his office offic and to answer to baid complaint within rive five days after the upon him of said summons if served upon him within said precinct for which the justice is acting and if served out of such precinct then within said five days from the date of its service with one day additional for every twenty five miles or fractional part thereof of the distance that the do de fondant may roside reside from tho office of the justice by the nearest traveled route and to which summons shall be annexed as a part thereof a certified copy of the certificate of appraisement in said case and in other respect said BUMM summons shall bo be same in form as other aum summonses in justices courts in civil actions and shall deliver said summons to the consta ble of the precinct for service and said justice shall hear try and determine said isaid case in tho the same manner as other civil cases are brought and def determined in justices courts and shall in all other respects proceed as in other civil cases see sec 4 sec 9 the constable shall receive hold and properly caro care for all animals committed to fco his custody under the provisions of this act pending th the determination of the cause and shall immediately upon receipt of the summons hereinafter provided for serve the same as follows first if the defendant is known and a resident of the precinct by delivering to him personally personal lj a copy of the summons or by leaving at his usual place of residency with some suitable person parson over the ago of fourteen years a copy thereof second it if the defendant defea dant bo be known and is not nob a resident of tho precinct then bv br depositing in the postoffice peato poato effice office postage prepaid and registered a loiter letter containing a copy of said su summons nimons addressed to the defendant at his known place of residence third if the defendant is unknown and af afler or dil diligent gent search and inquiry made hy by the Con constable he shall be unable to dis discover coyer the defendant at his place of real residence dence he shall post up three copies of the summons in three conspicuous places in the precinct one of which shall be at or noar near the abo office of the justice and in addition thereto he shall mail by registered letter a copy of said sum mon s to the county clork clerk of tho the county where such damage was done and the county clerk shall upon receipt of said summons post the same in i some conspicuous place at or near the court house horse and in aliases all tases ho he shall make his returns in oc ordanie with tho facts and the summons shall be doomed deemed to be served upon the delivery of tho the copy the flie ni mailing ailing of a copy by registered letter leter or by posting of copies as hereinbefore herein before provided |
