Show O OA OUR UR THOUGHTS TURN TO SPRING A regular old time Chinook breeze this week yeek just naturally turned a persons person's thoughts to spring We are not quite ready to hang ang up our winter coats oil up the seed planter and pull out our rod and reel experience has taught us that there is probably probably probably ably a lot of cold weather veather in store for us yet but spring really is not so far away vay and ad with spring will vill come the largest caravan of tourists on U. U S. S Highway Highway High High- way vay T 40 that the Basin has ever seen if we ve read the signs rightly There are now v only about 35 miles of unpaved highway high on U. U S. S 40 in Utah and according to a recent recent recent re re- cent report from the Colorado State road commission commission commis commis- sion they have about the same amount with funds already appropriated for the completion of most of it next year Many of the new v road maps will vill reveal I these facts but many will vill not and it should be an important import import- ant part of the programs of all the ci civic civile clubs of the basin to publicize the fact that Highway 40 is now v in infine infine infine fine shape for tourist travel Now is the time to start planning this kind of publicity p February March and April will vill come and go pretty fast and May marks the beginning of the tourist season and most vacation vacation vacation vaca vaca- tion trips are planned before that time While ve we are at it we ve must not stop at the the- publicizing publicizing publicizing pub pub- of highway high 40 The tourist who merely drives through does little to help us but there are many attractions attractions at at- tractions in the Uintah Basin worth stopping g for and when a tourist stops tops he begins to spend money Our job is to let them know v about the places worth taking side trips to visit The Basin never has and probably never will vill depend depend depend de de- pend upon tourist travel for fOl its main source of income income in in- come but extra dollars are vely velv velvet et t dollars and whether er tourist camps hotels service stations or of cafes we all get a shot at the extra money sooner or later and should all be interested in enticing it to come and to stay Spring is not yet here but it is not far off and it is time for the civic clubs of the Basin to start I boosting their section of the state TWO VO CONFLICTING TAX DECISIONS It looks like the stage is set for an interesting game of legal poker between the state of Utah and andr r the various counties of the state In a court decision handed down do Tuesday by T Judge James W. W McKinney of the 3rd Judicial District the state was yas upheld in its injunction suit against Salt Lake county restraining restraining restrain restrain- ing mg it from collecting delinquent taxes on property acquired by the state land board This decision is the direct opposite osite of that handed down do some time ago in in Duchesne when Judge Abe Turner sustained County County County Coun Coun- ty Attorney L. L A A. Hollenbeck's demurrer to a similar similar simi simi- simi simi- lar injunction holding that the taxes against the property were vere a good and valid lien by the county and that the state must pay all back taxes before it itcan itcan itcan can acquire a clear title to the property One or both of these cases will vill probably be carried car car- reed lied to the supreme court for a decision on which will vill affect some acres of land scattered throughout through through- out the state Since Duchesne county won its decision it would appear that the argument prepared by Mr H Hollenbeck Hollenbeck Hollen- Hollen beck was better prepared and that its case would be the better one to take before the Supreme court from the standpoint of the counties for the decision made on the first case brought before that court will vill probably set the precedence for any others other s that might follow v or will settle the matter definitely On this case however it is is up I to the state to make the next move Judge Turners Turner's decision renders the taxes collectible collectible collectible col col- col- col and the state must either pay or of appeal the case In Salt Lake county the tables are turned and the county bounty must either forego the taxes or of appeal the case The game then it would appear develops into one of watchful waiting on the part of the counties to see if the state will vill take the Duchesne case to the Supreme court If the Salt Lake county case goes first the counties will vill be defending the ti weaker case Whichever way vay it goes however it would seem seema a wise vise move on the part of Salt Lake and other counties counties counties coun coun- ties to throw their lots together and throw v their combined combined combined com com- resources and power ver in support of a defense based on Mr Hollenbeck's arguments |
