grain shipped in interstate or foreign commerce became a law on august 11 1910 the act authorizes the secretary of agriculture to investigate the handling and grading of grain und and to elta establish blish na as soon as may bo be standards for corn wheat rye oats barley flaxseed and other grains not less than 00 days 11 public lc notice mastbe given in advance ot of tho the date on which any such standard becomes effective Wh whenever edever such standards are stab bishea tor for any grain tho the act forbids tho the shipment or delivery for shipment in interstate or foreign commerce originating in the united states of any such grain which Is sold offered for sale or consigned for salo sale by grade unless it Is inspected and graded by a licensed inspector either tit at the place of shipment at a polut point tit in transit or nt at tho the destination in case no licensed inspector Is located either cither tit nt the lie point of shipment or nt at the point of destination the grain may bo be shipped without inspection in which event either party to tho the transaction may refer any dis dig ns to tho the grade to the secretary of agriculture when grain shipped or delivered for shipment in interstate or foreign commerce in erce Is required to be inspected all and d graded by n licensed laspee inspector for it Is made unlawful for any person to represent se tit that tt it Is of a grado grade other th than tin that stated in a certificate issued ln in compliance with the act shipment by sample permitted the act permits thu the shipment in interstate ter state or foreign commerce of grain sold by sample or by type or under any description which Is not false and misleading and does not incline any of the terms of tle ae official grata grain standards tito tho secretary of agriculture Is authorized zed to examine grain that h ahna s been certified to conform to any gra grade do of the official grain standards or that has been shipped in interstate or foreign el it commerce if after an opportunity tul ity for li hits has been given to the interested purt hurtles les it Is determined that any such grain it hoa been incorrectly certified or has hag been sold under a n name description or designation which Is false or misleading he way may publish his findings right of appeal when grain shipped in interstate or foreign comin commerce ereg has been inspected as required by the act any interested party may either with or without appeal the question of its grado grade tn the secretary of agriculture tho he secretary of agriculture Is authorized zed to determine the true grade of the hie grain and his bis findings aremady are made prima facto facie evidence of that fact in suits between the parties in federal courts reasonable fees may be charged charge for hearing disputes and appeals when appeals are sustained such fees feeo are to be refunded every person employed to inspect i and grade for shipment in ill enters inters interstate tato or foreign commerce Is prohibited from certifying the grain according to the ofIl grain standards unless he holds an and uni evoked license issued by the secretary of agriculture licensing inspectors any person who presents satisfactory evidence of competency may bo be licensed as an inspector under tho the act in states which haye or may hereafter have state grain inspection departments the secretary ot of agriculture Is required to issue licenses licensee to persons authorized and employed to inspect and grade grain under the laws of such states licensed inspectors and per sons employed by tho the secretary ot of agriculture ri for carrying out tho the provisions of the act are arc prohibited from having any interest in any grain elevator or warehouse or in the merchandising chan dising of grain or from being employed by any person owning or operating any grain elevator or warehouse licensed inspectors tire are required dired to keep records of all grain inspected by them and to make de detailed reports to the secretary of agriculture the license of any inspector found to be in competent or to have issued any false certificate of grade crade or to have violated any provision bt bf the act may be suspended or revoked by the secretary ot of agriculture i penalties any licensed inspector who knowingly inspects or grades improperly grain shipped la in interstate or foreign commerce or knowingly gives any false certificate of grade or accepts a bribe for or neglect or improper performance of duty may also be punished by line fine or imprisonment or both similar punishment muy may be imposed upon other persons who violate certain portions of the net act particularly those with derence re rence to the inspection Insi lection by licensed inspectors of grain shipped in interstate or foreign commerce an appropriation of Is made for the enforcement of the net act the necessary rules and regulations will be ba prepared and published at the tha earliest possible date in order that persons interested may have an opportunity to become familiar biti them before duay itay of the standards become effective 1 objects sought in th the c act the benefits which the act seeks to confer are described in the language used in the annual report of 1014 1914 ot of the secretary ot of agriculture with particular reference to tho the establishment of standards of corn grades for that grain it if generally adopted and uniformly applied throughout the country will simplify the relations between producers dealers and consumers under those these grades fairly used the grower or shipper of a superior quality of grain will be in ft a position to demand from tho the buyer the fair value to which the quality of his bla product entitles him on tho the other hand band the producer of a product
