(2) Necessary grading and street paving or partial par-tial street paving adjacent to most, but not all, of the streets on which the curb and gutter improvements improve-ments will be constructed construct-ed and installed, as described de-scribed in subsection (1) above. Preliminary plans and specifications showing show-ing the exact location and extent of the street paving pav-ing are on file at the office of the City Recorder, and may be examined at any time during regular business busi-ness hours. Section 3. The construction construc-tion of said street and avenue improvements in and for the District, as shown by the plans, specifications spe-cifications and maps thereof, approved by the City Council of the City and now on file in the office of-fice of the City Recorder, be and the same is hereby authorized and ordered, the material to be used in accordance with such the construction of said street and avenue improvement improve-ment to be in accordance with such maps, plans and specifications. Section 4. The estimated total cost of the street paving improvements, to be paid by he City, is $286,500; the estimated total cost of curb and gutter improvements, cross ojrains and drainage improvements, im-provements, to be assess ed against the property which fronts and abuts on the improvements, and included in-cluded within the District, is $204,640. The unit cost per front or abutting foot will be as more particularly particu-larly set forth in the Notice No-tice of Intention, as provided pro-vided by a Resolution of the City Council, passed and adopted on July 28, 1970. If the actual cost of the improvements exceeds ex-ceeds the estimated cost as set forth above, and in the Notice of Intention, the City Council shall nevertheless nev-ertheless have the right to levy assessments in excess ex-cess of the estimated cost. Section 5. The whole or any part of the assessment may be paid without interest in-terest within fifteen days following the effective date of the assessment ordinance. or-dinance. If the assessment is paid in part, the unpaid balance shall be payable in substantially equal installments in-stallments over such period per-iod of time as will be set forth in said ordinance. The first of such installments in-stallments of assessments shall be due and payable at such time as may be determined in and by th: Assessment Ordinance and the remainder of said installments in-stallments shall be due and payable successively on the same day in each year thereafter until all are paid in full. The rate of interest to be paid on iu'tipaid and deferred installments in-stallments of assessments will be established by ordinance or-dinance to be adopted by the City Council at a later date. Section 6. By virtue of and pursuant to the laws of the State of Utah, particularly par-ticularly the Utah Municipal Munici-pal Improvement District Act, special improvement bonds of the City shall be issued for the purpose of paying for the costs of the improvements described in this Ordinance, in an amount am-ount : not to exceed the cost and expenses of said improvements. The amount am-ount of such special improvement im-provement bonds shall not exceed the unpaid balance of the assessments at the end of the fifteen day period per-iod after the effective date of the ordinance levying levy-ing the assessments. If necessary, the City Council Coun-cil is authorized to issue interim warrants in ac cdrdance with the provisions provis-ions of Section 10-16-10, Utah Code Annotated, 1953, and such interim warrants, war-rants, together with interest in-terest thereon, shall be payable from the proceeds of the sale of special improvement im-provement bonds, or in cash received from the payment of assessments. Section 7. The Mayor and the City Recorder are hereby authorized to advertise ad-vertise for bids to construct con-struct such improvements by. publication of a notice td contractors at leastt one time in a newspaper having general circulation in the City of : Moab, at least fifteen days before the date specified for the receipt of bids. Section 8. The City Council hereby finds and determines that the improvements im-provements proposed to be constructed and installed install-ed will confer a special benefit upon the property within the District and a general benefit upon the City as a whole. Section 9. Any person who has failed to file a protest or otherwise to1 present an objection within with-in the time specified, shall be deemed to have waived any objection to the creation of the special improvement district; such waiver, however, shall not preclude his or her right to object to the amount of the assessment at the hearing on the assessment roll at a later date. Section 10'. All ordinances, ordin-ances, or parts thereof in conflict herewith are hereby here-by repealed. This Ordinance, Ordin-ance, after its final passage, pas-sage, shall be recorded in a book kept for that pur- ' pose, shall be authenticated authenticat-ed by the signatures of the Mayor and City Recorder, Re-corder, and shall be published pub-lished in a newspaper published pub-lished in the City of Moab. Section 11. That if anyone any-one or more sections or parts of this Ordinance shall be adjudged unenforceable unen-forceable or invalid, such judgment shall not affect, impair or invalidate the remaining provisions of this Ordinance, it being the intention that the various var-ious provisions hereof are serevable.
