D Call presiding In the case of ot i Thomas and others against I William Malouf The case was an action to recover money advanced by Gledhill under an oral agreement for tor the sale of ot certain land and water rights situate in Sevier county Gledhill Gledhill hill hlll appealed from the decision of the lower court which found That whatever service the de defendant defendant de- de rendered in trying to obtain water for the aforesaid lands was done for lor the mutual benefit of the plaintiffs and defendant The court finds In favor of the defendant and against the plaintiffs on the demands made In the com com- plaint The court finds for the plaintiffs and against the defendant on the demand in n the counter claim for services The court further finds that the plaintiffs and defendant in May 1919 had had some talk in hi which the proposition of the plaintiffs taking the whole of said tract of land was discussed but no payment was made thereon and no note or memorandum of agreement was made to this this' effect Finding no prejudicial error In the record and for lor the reasons stated the Judgment and anel decree says the supreme court of the district court is affirmed Costs to defendant However since the time allotted by the district court for tor the plaintiff to comply with the decree has expired I pending proceedings on appeal to this court let the case be remanded to I I grant the plaintiffs such further timeto time timeto to comply with the decree as may I appear to be just and reasonable I
