J Dininny city attorney ad advised the city this morning in committee of of the whole that it would be illegal for the eity to attempt to or any sum to be spent on the widening and straightening of Big Cottonwood canyon as a means of protecting the city's water supply from pollution As a result this propos proposed d method of eliminating ting pollution from the road bids fair to be a failure unless Salt Lake county will agree to bear of the expense of ot the proposed pro posed improvement The matter will willbe willbe be taken up with the county commission commission commis commis- sion by Commissioners Heber M. M Wells and W. W H. H Shearman Dininny who was called into the meeting declared that under the law the city could not legally make such an appropriation He advised that the law Imposes upon the county the duty of maintaining a proper road and that the city cannot lawfully spend money on a county road even though the end to be attained is protection of ot the health of the city Commissioner Wells pointed out that unless the traction train method of handling ore from the canyon can be provided there will be six hundred horses going up and down the canyon can yon all summer and the water will receive three times the quantity of I filth fUth it did last summer from this source I |
