G Luke manager manager manager man man- ager of the Merchants' Merchants Protective Protective tive association charging him with conducting a collection business without having filed flied Wi with 11 the state a bond of as required by the state law It is alleged that Luke ha has conducted conducted conduct conduct- ed his business from May 17 1915 to March 4 1916 without having filed flied the tho required bond s Continued efforts made by the secretary secretary sec sec- rotary of state for the last nine nin months to have Francis G. L Holman deputy secretary of state to today today to- to day asked the county attorney for a a. complaint against Luke which was issued He is charged with a misdemeanor misdemeanor meanor the 1913 statutes providing a punishment of as much as as s fine or three months in Jail or both for fail ure to comply with the law May Seek It t was stated at both the office of the secretary of state and attorney general that Luke has had no bond since May 1915 when his bond of the preceding year expired In spite of that fact Luke is alleged to have advertised advertised ad ad- he was bonded with the state In addition to the criminal complaint com corn plaint the attorney general will also be asked to start injunction proceedings proceed proceed- ings lags to enjoin Luke from publishing on letter heads a copy of a certificate of bond issued three years ago This certificate was to the effect that a bond had been filed at that time It was granted in May 1913 and ran but buta a year but is now used on his stationery station station- ery cry in spite of the fact that It expired in May 1914 In response to h ft demand by state officials made last spring that he be renew renew renew re re- re- re new his bond Luke submitted what purported to be a personal surety bond Examination disclosed it to be Inv invalid Luke having failed to sign it as principal In addition to this objection it was found that the sureties sureties sure sure- ties offered were not sufficient The bond was supposed to be for Says Luke Promised After a thorough ex examination min Uon and investigation as to the responsibility of the proposed bondsmen T. L Holman Holman Hol fbi man deputy secretary of state called Luke to his office and explained that the bond would be rejected Luke then it is declared promised to promptly furnish a proper bond Since last summer various attempts by letter and telephone have been made to obtain this bond It is s said ld Since the old bond had expired and there was no new one clients of the agency remain unprotected A final effort was made In February and when no action was had Luke was officially notified he would have until March 1 to give bond That date having passed action has been begun Even if Luke now files a proper bond we intend to push this case against him said Holman today He Heis is falsely advertising that he is bonded bond ed in this state We intend to see that he changes his letter heads at least so that the long expired bond certificate I. A R.
