Bert Rhodes was bound over to the District court this morning by Judge C. B. Dlehl, in the State dlvlslonNf the City court, to answer to a charge of burglary.' bur-glary.' Rhodes was arrested severai nights ago by the watchman of the Big Boston store, who found him in the store In the early hours of the morning. f , In his preliminary examination this morning. Rhodes swore that he was 24 Jears old, a cook, and had served three years In -the regular army in active ser-ice ser-ice in the Philippines. He had been honorably discharged;March 16th, last year, and was married two days later. ' . Rhodes testified that he had been out of work-threeweeks. He had looked for work every day, but was unsuccessful in his, search.". -He had applied for work In every restaurant and hotel in the city, but could not. find an, opening. , He had 'been supported by his friends, and was nearly .insane -over his misfortune. The day the alleged burglary was .committed Rhodes had not eaten a meaL 'Stepping into the alley, he saw the coal chute, in the Big Boston store leading to An open window. Believing he could :get something to eat he entered the store, and not finding anything edible he opened the cash drawer. There were several .dollars in the till, but he took only 25 cents,; not disturbing the remainder. He sat 'on the counter when he had closed the cash, drawer, and made no effort to escape when he heard the watchman approaching. He was unarmed when arrested. Rhodes's wife, who was .In the courtroom during, the hearing, could not control con-trol her grief and burst into tears during, the,examlnatlon. She nearly collapsed when Judge Dlehl bound her -husband over to the District court, fixing his bonds , at $100. ' ..:'.'
