Attorney Smith for the defense made aa effort this morning before Judge -Morse to secure a new trial for James M. Shockley, convicted of the ; murder of Brighton and Gleason. the street car men. The passing of sentence on Shock-ley Shock-ley was postponed from last Monday until today to allow his attorneys time to prepare their motion for a new trial. Several Grounds Alleged. The grounds upon which the motion was made were that the court was in error in that Shockley was compelled to answer numerous questions over his objections, ob-jections, which were incriminating and in some cases Irrelevant and of a nature na-ture to prejudice the Jury against the prisoner. It was also argued that the questions as to his desertion from the United States army put the prisoner In a wrong- light before the Jury.' It was cited that many persons feel that a deserter de-serter from the army would be capable of any other crime. This, it was alleged, was sound argument and would be held as evidenoe which was not in print, which would not bear on the case and certainly put the Jury in a mood which was unfavorable to the accused. Ia criminating Admissions. It was also cited that the aCmlssions which were forced from him concerning concern-ing other crimes was of an incriminating- nature and had no bearing on the case. . Numerous cases were brought to the attention of the court which war in- v tended to show that the court was In ' error. It was also held that the court was in error In that it refused to Instruct the accused in various points of the case, where, had proper Instruction been given, the testimony would have been different. On the conclusion of Mr. Smith's argument ar-gument the court took a recess until 2 o'clock. At the hearing of the motion for a new trial ware a large number of school girls. . |
