There was a good Joke on Prosecutor DavejWlHey in Police court yesterday afternoon. -The beauty of the Joke was that while it appealed to every one else in the courtroom, Willey" could not see where the humor came in. The case of the city against James Parry had been tried. ' Parry was charged with assault and battery. The defendant and another witness testified as to the Innocence of the defendant, and said that the complainant had been hurt by the fall of a track-Jack on his foot. The prosecution contended that the defendant had thrown a rock at the plaintiff. Prosecutor Willey, In his argument, ar-gument, said that no sane man would believe the testimony of the defendant. Attorney Weber, representing the defendant, de-fendant, said he would not insult the court by making an argument. Then the court sprung the Joke on WiUey. ' Judge Diehl said: "This court may not be sane, but. Mr.1 Willey, you have practiced law long enough to know that the weight of the testimony in favor of the defendant raises a reasonable rea-sonable doubt which precludes conviction. convic-tion.
